A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF SANTA MONICA AUTHORIZING THE CITY MANAGER
TO EXECUTE AN AGREEMENT OF INDENTURE FOR A
WATER LINE CROSSING OF THE SOUTHERN PACIFIC
TRANSPORTATION COMPANY RIGHT-OF-WAY
WHEREAS, infrastructure rehabilitation requires the
replacement of a water line on 17th street between Colorado
Avenue and Olympic Boulevard in the city of Santa Monica; and
WHEREAS, said water line will cross the land owned and
utilized as railroad right-of-way by the Southern Pacific
Transportation Company; and
WHEREAS, Southern Pacific Transportation company
desires to enter an indenture with the city of Santa Monica for
the construction, maintenance, and operation of said water line
across said land owned and ulitized as a railroad right-of-way;
and
WHEREAS, the Southern Pacific Transportation company
has requested the sum of $395 (three hundred ninety-five dollars)
as consideration for said indenture.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SANTA
MONICA DOES RESOLVE AS FOLLOWS:
Section 1. That the City Manager be authorized to
execute an indenture for construction, maintenance and operation

of a water line crossing of the land owned and utilized as
railroad right-af-way by Southern Pacific Transportation Company
at 17th Street between Colorado Avenue and Olympic Boulevard in
the city of Santa Monica with the Southern Pacific Transportation
Company.
Section 2. That in consideration of said indenture,
the City of Santa Monica will pay to the Southern Pacific
Transportation company, the sum of three hundred ninety-five
dollars ($395) from the Water Fund.
Section 3. The City Clerk shall certify to the
adoption of this resolution and thenceforth and thereafter the
same shall be in full force and effect.
