RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA
MONICA CONFIRMING THE REPORT OF THE SUPERINTENDE~T
OF STREETS REGARDING REPAIRS TO DAMAGED SIDEWALKS,
DRIVEWAYS AND CURBS (SR-86-76)
WHEREAS, the Street Super1ntendent of the C1ty of Santa
Mon1ca, pursuant to Section 5600 to 5630 of the Streets and Highways
Code, commenced proceedings to cause the repaIr of damaged sIdewalks,
driveways and curbs 1n the City of Santa Monica at 2522 32nd St., 2516
32nd St., 2629 32nd St., 2632 32nd St., 2667 32nd St., 2637 32nd St.,
2528 32nd St., 2316 32nd St., 2324 32nd St., 2313 32nd St., 2320 32nd
St., 2307 32nd St., 2269 32nd St., 2332 33nd St., 2329 32nd St., and
2333 32nd Street, all wIthin the City of Santa MonIca.
WHEREAS, SIxty days after saId order was served, the work had
not been completed by the owners or persons In possession of the
affected propertIes, and the Superintendent of Streets caused the work
to be done; and
WHEREAS, the SuperIntendent of Streets gave the notIce
reqUIred by SectIon 5616 of the Streets and H1ghways Code~ and
WHEREAS, the SuperIntendent of Streets dld flle with the Clty
Councll of the Clty of Santa Monica hlS report of repalrs and cost as
required by SectIon 5617 of the Streets and HIghways Code~ and
WHEREAS, upon the day and hour fixed for hearIng by Resolution
Number 7146 (CCS), the CIty Counc11 of the CIty of Santa Monica heard
and passed upon the report of the SuperIntendent of Streets together
WIth all obJectIons and protests as reqUIred by Section 5618 of the
Streets and HIghways Code~

NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SANTA MONICA
DOES RESOLVE AS FOLLOWS:
SECTION 1.
The report of the Superintendent of Streets
heretofore f1led and above-described be and the same 1S hereby
conf1rmed.
SECTION 2.
All protests and obJections of every k1nd and
nature to the report of the Superintendent of Streets be and the same
are hereby overruled and denIed.
SECTION 3.
The cost of the repairs, as set forth in the
report of the SuperIntendent of Streets, shall be assessed against the
properties there1n described, Wh1Ch properties front upon the sidewalk
upon which the repaIrs were made.
SECTION 4.
If such assessment IS not paid withIn the t1me
permitted by law, the same shall constitute a special assessment
aga1nst and 1 ien on the proper ties therein descr 1bed, 1n the amount
set forth in the report of tne Superintendent of Streets, which lien
shall cont1nue until the assessment and all interest thereon is paid
or until It is dIscharged of record.
SECTION 5.
If the assessment is not paid within the time
perroi tted by law, the Super intendent of Streets, In accordance with
Section 5628 of the Streets and Highways COde, shall deliver a Notice
of LIen, prepared In the manner required by Sect10n 5626 of the
Streets and H1ghways Code, to the County Aud1tor who shall collect the
assessment together with all other taxes aga1nst the property.

SECTION 6. The C~ ty Cler k shall certify to the adoption of
th~s resolut~on and thenceforth and thereafter the same shall be in
full force and effect.
