RESOLUTION NO. 7171{CCS)

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA
MONICA CONFIRMING THE REPORT OF THE SUPERINTENDENT OF
STREETS REGARDING GUTTER CONSTRUCTION AND STREET
RESURFACING ON VARIOUS CITY STREETS
WHEREAS, the Street SuperIntendent of the City of Santa
Monica, pursuant to Section 5870 et seq. of the Streets amd
HIghways COde, commenced proceedings to cause gutter constructIon
and street resurfacing on:
MIchigan Avenue from C10verfleld to the easterly end
Broadway from 17th Street to Clover field
Nebraska from Stewart Street to CentInela Avenue
CommercIal/Industrial PortIons of:
32nd Street from PICO Boulevard to Ocean Park Boulevard
33rd Street from Pico Boulevard to Ocean Park Boulevard
WHEREAS, the Superintendent of Streets served the notIce
required by SectIon 5876 of the Streets and HIghways Code and the
Clty CouncIl of the City of Santa Monica held the hearing
required by SectIon 5878.1 of the Streets and HIghways Code; and
WHEREAS, sixty (60) days after the notice was served, the
work had not been completed by the owners or persons in
possession of the affected properties, and the SuperIntendent of
Streets caused the work to be done; and
WHEREAS, the Superintendent of Streets gave the notIce
reqUIred by Section 5881 of the Streets and HIghways Code; and
WHEREAS, the Superintendent of Streets dId fIle WIth the
City Council of the City of Santa MonIca his report of

construction and cost as requIred by Section 5882 of the Streets
and H~ghways Code; and
WHEREAS, upon the day and hour f~xed for hearIng by
Resolution Number 7147 (CCS), the C~ty Counc~l of the City of
Santa Monica heard and passed upon the report of the
SuperIntendent of Streets together wIth all obJections and
protests as required by Sect~on 5883 of the Streets and Highways
Code;
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SANTA
MONICA DOES RESOLVE AS FOLLOWS:
SECTION 1. That the report of the Superintendent of
Streets heretofore filed and above-descr1bed be and the same is
hereby conf~rmed.
SECTION 2. That all protests and object~ons of every kind
and nature to the report of the Superintendent of Streets be and
the same are hereby overruled and denied.
SECTION 3. That the cost of construction, as set forth in
the report of the SuperIntendent of Streets, shall be assessed
againist the properties therein descrIbed, which properties front
upon the gutters and resurfaced streets so constructed.
SECTION 4. That ~f such assessment is not paid within the
time perm~tted by law, the same shall constitute a special
assessment agaInst and lien on the propert1es therein described,
in the amount set forth In the repor t of the Super intenden t of
Streets, WhICh l~en shall contInue until the assessment and all
interest thereon is paid or until it IS discharged of record.

SECTION 5. That If the assessment is not paid withIn the
tIme permltted by law, the Superintendent of Streets, in
accordance wIth Section 5893 of the Streets and Highways Code,
shall dellver a Notice If Lien, prepared In the manner requIred
by Section 5891 of the Streets and Hlghways Code, to the County
Auditor who shall collect the assessment together with all other
taxes agalnst the property.
SECTION 6.
That the City Clerk shall certIfy to the
adoptIon of this resolutlon and thenceforth and thereafter the
same shall be in full force and effect.
