A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF SANTA MONICA DECLARING ITS INTENTION TO
ORDER THE VACATION OF A PORTION OF THAT
CERTAIN STREET KNOWN AS 28TH STREET, IN THE
CITY OF SANTA MONICA, CALIFORNIA
THE CITY COUNCIL OF THE CITY OF SANTA MONICA DOES
RESOLVE AS FOLLOWS:
SECTION 1. The City Council of the City of Santa Monica
hereby declares its Intention to order the vacation of that
.
portion of 28th Street described in the legal description set
forth in Exhibit A, which is attached hereto and made a part
hereof, as shown on the Map of Tract No. 34609, in the City of
Santa Monica, County of Los Angeles, State of California,
recorded in Book 899, Pages 5 and 6, in the office of the
Recorder of said County.
For further particulars as to the proposed vacation of
the
hereinbefore
mentioned
area,
reference
is
made
respectively to DraWing No. 4321 now on file in the office of
the City Engineer In the City Hall, Santa Monica, California.
SECTION 2.
The City Council of the City of Santa
Monica, In vacating said portion of said 28th Street, intends
to reserve and except from sald vacation an easement of full

width over the full length of said portion of said Street

intended to be vacated, and the right at any time, or from
time to time, to construct, maintain, operate, replace,
remove, and renew all sanitary sewers, storm drains, water
mains, and other public utility facilities and appurtenant
structures. Reservations and exceptions as to existing public
utility facilities are described in DraWing No. 4323 now on
file in the office of the City Engineer, in the City Hall,
Santa Monica, California.
Additionally, the City CounCil of the City of Santa
Monica reserves an easement for purposes of a future street
and access route over a portion of 28th Street bounding Lot 3
of Tract No. 34609 up to the center line of said portion, as
more particularly described In the legal description of such
reserved easement, attached hereto as Exhibit B and made a
part hereof, and depicted on Drawing No. 4322 on file in the
office of the City Engineer, City Hall, Santa Honica,
California.
The City Council of the City of Santa Monica finds that
the public convenience and necessity require such reservations
and exceptions.
SECTION 3. The City Council of the City of Santa
Monica, in vacating the above mentioned portion of 28th
Street, elects to proceed under and in accordance with the
provisions of the Public Streets, Highways and Service
Easements Vacation Law, Streets and Highways Code Section 8300
et seq.

SECTION 4.
The hour of 7:30 o'clock p.m. of the 22nd
.
day of April, 1986, in the Council Chambers in the City Hall,
Santa Monica} California} be and the same hereby is fixed as
the time and place when and where all persons interested in or
objecting to the proposed vacation may appear before the City
Council and offer eVIdence In relation thereto.
SECTION 5.
The Street SuperIntendent of the City of
Santa Monica hereby is directed to cause Notices of Street
VacatIon to be posted as required by Streets and Highways Code
Section 8323.
SECTION 6. The City Clerk shall certify to the adoption
of this Resolution of Intention and shall cause the same to be
published in accordance with Street and Highways Code SectIon
8322.

SECTION 7. The City Clerk shall certify to the adoption
of this Resolution, and thenceforth and thereafter the same
shall be in full force and effect.

provement Act of 1911 for the con-
struction of concrete gutters and
street resurracmg, and
WHEREAS, SectIOn 19 of ArtIcle
XVI of the California Constltutlon
provides that certam speCified debt

prOViSIons shall not apply If, after
the g1.Vmg or such reasonable notIce
by pubhcatlOn and postmg and the
holdmg of such pubhc heanng as the
C1ty Council of the City of Santa
Momca shall have prescnbed, the
City Councll by no less than four-
