RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SA~TA
MONICA CO~FIRMING THE REPORT OF THE SUPERINTENDENT
OF STREETS REGARDING REPAIRS TO DAMAGED SIDEWALKS,
DRIVEWAYS AND CURBS (SR-86-77)
WHEREAS, the
Street Super~ntendent of the C~ty of Santa
Mon~ca, pursuant to Sectlon 5600 to 5630 of the Streets and H~ghwaY5
Code, commenced proceed~ngs to cause the repa~r of damaged 5~dewalks,
drlveways and curbs 1n the Clty of Santa Monica at 2521 32nd St., 2206

WHEREAS, sixty days dfter said order was served, the work had
not been completed by the owners or persons lD possess~on of the
affected propert~es, and the Super~ntendent of Streets caused the work
to be done; and
WHEREAS,
the
Superlntendent
of
Streets
gave the
not~ce
requlred by Sectlon 5616 of the Streets and Hlghways Code; and
WHEREAS, the Superlntendent of Streets dld flIe wlth the Clty
CounCll of the C~ty of Santa Monlca his report of repalrs and cost as
requlred by Sectlon 5617 of the Streets and Highways Code; and
WHEREAS, upou the day and hour flxed for hear~ng by Resolution
Number 7185 (CCS), the Clty Cauncll of the Clty of Santa Monlca heard
and passed upon the report of the Superl.utendent of Streets together

wlth all Ob]ectlons and protests as required by Sectl.on 5618 of the
Streets and Hlghways Code;
NOW. THEREFORE. THE CITY COUNCIL OF THE CITY OF SANTA MONICA
DOES RESOLVE AS FOLLOWS:
SECTION 1.
The report

nature to the report of the Superintendent of Streets be dnd the same
are hereby overruled and denied.
SECTION 3.
The cost of the repalrs. as set forth ln the
report of the Superintendent of Streets. shall be assessed agalnst the
propertles tnereln descrlbed. wh3.ch propertles front upon the 81dewalk
upon whlch the repalr8 were made.
SECTION 4.
If such assessment lS not pald W3.thln the t1me
perm1tted by law. the same shall constltute a special asseSSment
agalnst and 11en on the propert1es thereln de8cr1bed, ln the amount
set forth lU the report of the Superl.ntendent of Streets, which 11eu
shall contlnue until the assessment and all lnterest thereon 18 pald
or until It 1S d1scharged of record.
SECTION 5.
If the assessment 18 not pa1d wlthlil the time
perm1tted by law, the Super1ntendent of Streets, ln accordance "nth
Sect~on 5628 of the Streets and H1ghways Code, shall del~ver a Notlce
of L1en, prepared in the manner requ~red by Sect10n 5626 of the

Streets and Hlghways Code, to the County Audltor who shall collect the
assessment together wlth all other taxes agalnst the property.
SECTION 6.
The C~ty Clerk shall cert~fy to the adopt~on of
th~s resolutlon and thenceforth and thereafter the same shall be 1.n
full force and effect.
