R-7205 e e CA:RMM:lmd154/hpw City Council Meeting 4-22-86 Santa Monica, California RESOLUTION NUMBER 7205(CCS) (City Council Series) A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA MONICA DECLARING ITS INTENT TO LIMIT THE NUMBER OF FULL SERVICE FUELING PROVIDERS AT SANTA MONICA AIRPORT WHEREAS, the city Council of the City of Santa Monica desires to limit the number of full service fueling providers at Santa Monica Airport to a total of not more than two such providers; and WHEREAS, the City council of the City of Santa Monica, as the governing body of Santa Monica Airport, is authorized pursuant to the Public utilities Code to consider various factors and make a determination whether or not it is necessary to limit the number of agreements entered into pertaining to provision of certain goods and services at the Santa Monica Airport; and WHEREAS, the factors subj ect to such consideration, set forth in California Public utilities Code Section 21690.9, are as follows: (a) Public safety. (b) Public convenience. (c) Quality of service. (d) The need to conserve airport space. (e) The need to avoid duplication of services. - 1 - e e (f) The impact on the environment or facilities of the airport as an essential commercial and tourist center. (g) The need to avoid destructive competition which may impair the quality of airport services to the public, lead to uncertainty, disruption, or instability in the rendering of such services, or detract from the state I s attractiveness as a center of tourism and commerce, NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SANTA MONICA DOES RESOLVE AS FOLLOWS: SECTION 1. The City Council of the city of Santa Monica has considered each of the above factors and hereby finds that it is both necessary and in the best interests of the Santa Monica Airport and the public to limit the total number of full service fuel providers at Santa Monica Airport. Such limitation will avoid wasteful duplication of services and prevent destructive competition which might result in impaired quality of fueling services, uncertainty, disruption, or instability in the rendering of such services to the public. This determination of necessity by the City Council of the City of Santa Monica will assure the continued economic viability of the Santa Monica Airport, and it is hereby declared that the number of full service fueling providers at Santa Monica Airport shall not exceed more than a total of two. - 2 - e e SECTION 2.
