A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF SANTA MONICA TO AUTHORIZE THE CITY MANAGER
TO NEGOTIATE AND EXECUTE A CONTRACT FOR THE
PURCHASE OF DIESEL FUEL
WHEREAS, the City sent out Notices Inviting Bids to furnish
and deliver veh1.cle fuels for purchase by various City departments;
WHEREAS, e1.ght responses were received and all but one were
non-responsive resulting l.n the lack of competltive bids to
consider;
WHEREAS, staff has determ1.ned that the formal b1.dding
procedures are not conducive to meeting the City's goals on social
responsibility and as well as the City's specifications regarding
clean burn1.ng fuel;
WHEREAS, an open market purchase will permit the purchase of
d1.esel fuel at an acceptable cost and perm1.t the City to obtain
diesel fuel which meets City specifications; and
WHEREAS, the C1.ty Council has been requested to reject the
bids for diesel fuel;

WHEREAS, Santa Monica Municipal Code Section 2.24.100 (b)
provides for waiver of the standard bidding requirements, after
reJection of all bids, when necessary to address concerns such as
those set forth above.
NOW THEREFORE, THE CITY COUNCIL OF THE CITY OF SANTA MONICA
DOES RESOLVE AS FOLLOWS:
SECTION 1.
The C1.ty Council hereby rejects all bids for
diesel fuel.
SECTION 2.
In accordance with Santa Monica Mun1.cipal Code
Section 2.24.100 (b), the City Council finds and declares that
d1.esel fuel may be purchased under more favorable circumstances l.n
the open market.
SECTION 3. In accordance with Santa Monica Municipal Code
Sect1.0n 2.24.100(b), the City Council authorizes the C1.ty Manager
to negot1.ate and execute a contract for the purchase of diesel
fuel
SECTION 4. The City Clerk shall certify to the adoption of
this Resolut1.on, and thenceforth and thereafter the same shall be
in full force and effect.
