RESOLUTION NO. 8972 (CCS)

A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF SANTA MONICA APPROVING ASSESSMENT
DIAGRAM AND CONFIRMING ASSESSMENT COSTS FOR
THE RECONSTRUCTION OF 4TH COURT BETWEEN
COLORADO AVENUE AND BROADWAY, AND 9TH COURT
BETWEEN OL YMP I C BOULEVARD AND 476 I NORTH OF
OLYMPIC BOULEVARD
WHEREAS, the City of Santa Monica, pursuant to Section 5100 et
seq. of the Streets and Hlghways Code, commenced proceedlngs to
reconstruct alleys and appurtenant work on:
4th Court - between Colorado Avenue and Broadway, and
9th Court - between Olympic Boulevard and 4761 North of
OlymplC Boulevard,
all within the City of Santa Monica; and
WHEREAS, the proceeding ~s more fully described in the
Resolutlon of Intention adopted by the City Councll on April 27,
1993 be~ng Resolution Number 8577 (CCS) i and
WHEREAS, the contract for the above described work has been
fulfilled to the sat~sfaction of the Superintendent of Streets; and
WHEREAS, the Superintendent of Streets has made an assessment
to cover the sum due for the work performed and specified ln the

contracti and
WHEREAS, the assessment has been filed wlth the City Clerk;
and
WHEREAS, the City Clerk gave the notice required by Sections
5362 and 5363 of the Streets and H~ghways Code, and
WHEREAS, upon the day and hour flxed for hearlng by the City
Clerk, the City Council of the City of Santa Monica to hear and
pass upon any and all objections, appeals, and protests,
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SANTA MONICA
DOES HEREBY RESOLVE AS FOLLOWS:
SECTION 1. That all object1ons, appeals, and protests of
every kind and nature be the same are hereby overruled and denied.
SECTION 2. That the map of property affected and benefited by
the reconstruction of alleys and appurtenant work on:
4th Court - between Colorado Avenue and Broadway, and
9th Court - between OlYmpic Boulevard and 476' North of
OlYmpic Boulevard,
all 1n the City of Santa Monica,
Resolutlon Number 8577 (CCS) , and
as more fully described ~n
therein declared to be the

property to be assessed to pay the expense of the improvements, is
approved and the City Clerk is dlrected to execute the certificate
on the map to the Superintendent of Streets.
SECTION 3.
That the assessment of the reconstruction of
alleys and appurtenant work on:
4th Court - between Colorado Avenue and Broadway, and
9th Court - between Olympic Boulevard and 476' North of
OlyroplC Boulevard,
as more fully described in Resolution Numbers 8577(CCS}, be the
same hereby is confirmed and approved.
SECTION 4. That the Superintendent of Streets shall forthwith
attach a warrant to sa~d assessment bearing the date of this
confirmation.
SECTION 5. The assessment roll, warrant, and map shall be
recorded in the Offlce of the Superintendent of Streets, and
immedlately thereafter the City Clerk shall file a copy of the
assessment district in the Office of the County Recorder, and
thereafter shall record in sald Office of the County Recorder, a
Not~ce of Assessment, all in the manner and form as prescrlbed by
Sect~on 3114 of the Streets and Highways Code of the State of
Cal~fornla.

SECTION 6. The City Clerk shall certify to the adoption of
th~s Resolut~on, and thenceforth the same shall be ~n full force
and effect.
