R-8879 e e RESOLUTION NO. 8879 (City Council Series) A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA MONICA CERTIFYING THE FINAL ENVIRONMENTAL IMPACT REPORT ON THE UPWARD BOUND AFFORDABLE HOUSING PROJECT AT 1011 11TH STREET AND 1020 12TH STREET WHEREAS, a Notice of Preparation of an Env~ronmental Impact Report was issued in October, 1992; and WHEREAS, a Notice of Completlon of a Draft Environmental Impact Report as published in March, 1993, in compllance with the Callfornla Environmental Quallty Act and the City of Santa Monica CEQA Guidellnes; and WHEREAS, in August, 1993, the Final Environmental Impact Report was published; and WHEREAS, on October 27, 1993 the Plann~ng Commlsslon, as Lead City Agency, reviewed and certified the Final Environmental Impact Report, WHEREAS, on January 18, 1994, the Clty Council revlewed the F~nal Envlronmental Impact Report after the Planning Commission's certlflcation was appealed, e e NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SANTA MONICA DOES HEREBY RESOLVE AS FOLLOWS: SECTION 1. The City Councll has reviewed and considered the Flnal Environmental Impact Report on the Upward Bound Affordable Housing ProJect located at 1011 11th Street and 1020 12th Street prior to and in connection with its determination of whether or not to approve the proJect. SECTION 2. The City Councll certlfles that the envlronmental review for the proJect was conducted and the Environmental Impact Report was prepared ln full compllance wlth State and Clty CEQA Guidellnes, that there was adequate public review of the Draft Environmental Impact Report, that it has consldered all comments on the Draft Envlronmental Impact Report and responses to comments, that the Final Envlronmental Impact Report adequately dlscusses all significant environmental issues, and that the City Council has consldered the contents of the Flnal Environmental Impact Report in ltS declslon-making process. SECTION 3 Consistent with Article VI, Sectlon 12 of the Clty CEQA Guidelines and Sectlon 15091 of the State CEQA Guidelines, the Clty Councll finds that there are no reasonable and available alternatives to the project that would slgnlflcantly and substantially reduce the lmpact on the environment WhlCh would accompllsh the project objectives, and would be consistent with the land use goals of the Clty as set forth in the standards of the It e Zoning Ordinance and General Plan The only unavo~dable adverse impact ldentlfled ln the Final EIR is the lmpact of constructlon at the slte, whlch will be temporary and w~ll be substantially mitigated by a number of construction mit~gation measures, includ~ng, but not l~mlted to, limiting the hours during which construction will be permitted, requiring measures to mlnlmlze dust emiss~ons, and reduclng the amount of noise generated during constructlon, The proJect lS consistent with affordable hous~ng objectlves contained withln the Housing Element of the General Plan and residential land use objectives contalned wlthin the Land Use and Clrculation Element of the General Plan. The short-term impacts of constructlon are considered acceptable and are found to be over-riden by the consideration that the proJect wlll provide a number of long-term beneflts, lncluding the provision of housing for low income seniors and homeless families and the provls~on of addltlonal off-street parklng in the neighborhood. SECTION 4. The Clty Council hereby makes a Statement of Overriding Considerations, pursuant to Article VI, Section 13 of the Clty CEQA Guidelines and Sectlons 15091 and 15093 of the State CEQA Guidelines I and flnds that whlle the Flnal Environmental Impact Report lndlcates that there may be slgnlflcant effect nOlse, dust levels and exhaust emissions during construction, these effects will be temporary ln nature and will be substantlally mitigated by conditions limiting the hours during which construction will be permitted, requiring measures to minimize dust emisslons, and reducing the amount of noise generated during e e construction. The City councll, therefore finds that, as substantlally mitigated by the specified requirements, the potent~al ~mpact on noise, dust levels and exhaust emissions during construction is acceptable, SECTION 5. The C~ty Council shall certify to the adoption of this Resolution, and thenceforth and thereafter the same shall be in full force and effect.
