A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF SANTA MONICA DECLARING ITS
INTENTION TO ORDER VACATION OF EXCESS STREET
RIGHT-OF-WAY AT THE NORTHWEST CORNER OF
OLYMPIC BOULEVARD AND 21ST STREET
WHEREAS, the City of Santa Monica has determined that the real
property (the "Property") described ln section 1 of this Resolution
15 no longer needed for the purpose acquired and that said surplus
parcel is not needed for any public use or street purpose; and
~VHEREAS, since utility lines and appurtenant structures are
located on, above or beneath the Property, the city council of the
Clty of Santa Monica will reserve easements in favor of public and
private utility companies and their respective agents, employees
and representatives for purposes of construction, operation,
ma1ntenance, repair, removal and replacement of all sewer, water,
storm drain, street lights, traffic signals, electrical, gas,
telephone, cable TV and other utility facilities and improvements;
and
WHEREAS, the sale of the Property to the adjacent property
owner Sam Tsunoda has been authorized; and

WHEREAS, vacation of the Property must be completed before
sale of the Property occurs:
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SANTA MONICA
DOES RESOLVE AS FOLLOWS:
SECTION 1. The City Council of the city of Santa Monica
declares its intention to order vacation of the excess street
right-of-way parcel located at the northwest corner of Olympic
Boulevard and 21st Street which is further described as follows:
That portion of Olympic Boulevard in the City of Santa Monica,
County of Los Angeles, state of California, relinquished by the
State of California to the said city per deed recorded on March 28,
1966 in Book R2523, Page 769, of official records of said County;
said land also being portions of Lots 5,7,9, and 11, Block 20
Erkenbrecher Syndicate Santa Monica Tract, as shown on map filed in
Book 6, Pages 26 and 27, of Maps, in the office of the Recorder of
said County, within the fOllowing described boundaries:
Commencing at the most westerly corner of said Lot 9; thence
along the southwesterly line of said lot, South 44042'53"
East, 26.59 feet to a point on the southwesterly line of said
lot, said point being the True Point of Beginning; thence
continulng along the southwesterly line of said Lot, South
44042' 5311 East, 11. 00 feet to the beginning of a tangent curve

concave to the north having a radius of 10.00 feet, thence
northeasterly along said curve through a central angle of
75059159" a distance of 13.26 feet; thence North 59017'08"
East tangent to said curve ~2.81 feet; thence to the beginning
of a non-tangent curve concave to the northwest and having a
radius of 795.00 feet, a radial of said curve to said point
bears North 69045155" West, thence northeasterly along said
curve through a central angle of 3030'3211 a distance of 48.69
feet; thence North 16043'3211 East tangent to said curve 89.71
feet; thence North 13059'3511 West 15.49 feet; thence North
44042'42" West 25.14 feet; thence South 16043'32" West 115.06
feet to the beginning of a tangent curve concave to the
northwest and having a radius of 765.00 feet; thence
southwesterly along said curve through a central angle of
4006'40" a distance of 54.89 feet, more or less, to the True
Point of Beginning.
SECTION 2. The City Council of the city of Santa Monica in
vacating the Property described in Section 1 of this Resolution,
elects to proceed in accordance w1th the provisions of the
California Streets and Highways Code, Part 3, IIpublic Streets,
Highways and Service Easements Vacation Law", Chapter 3, uGeneral
Vacation Procedure."
SECTION 3. The hour of 6:30 p.m. on the 23rd day of May 1995,
in the council Chambers in city Hall, 1685 Main street, Santa

Monica, california, be and the same hereby is fixed as the time and
place when and where all persons interested in or objecting to the
proposed vacation may appear before the City Council and offer
evidence in relation thereto.
SECTION 4.
The Director of Environmental and Public Works
Management Department is hereby directed to cause notices of street
vacation to be posted as required by California Streets and
Highways Code Section 8323.
SECTION 5.
The city Clerk of the city of Santa Monica is
directed to cause notice of the date, hour and place of the public
hearing to be published once a week for at least two successive
weeks prior to the hearing as required by California streets and
Highways Code section 8322.
SECTION 6. The City Clerk shall certify the adoption of this
Resolution, and thenceforth and thereafter the same shall be in
full force and effect.
