A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF SANTA MONICA WAIVING ADVERTISEMENT
REQUIREMENTS AND AUTHORIZING THE SALE OF REAL
PROPERTY LOCATED AT THE NORTJiwEST CORNER
OF OLYMPIC BOULEVARD AND 21ST STREET
WHEREAS, on March 16, 1966, the state of California
relinqulshed the real property described in Section 2 of this
Resolution (the "Property") to the City of Santa Monica, for use as
a City street; and
WHEREAS, The City has determined that the Property is no
longer needed for the purpose acquired and that said property is
not needed for any public purpose; and
WHEREAS, The State of California has confirmed it has no
objection to the proposed sale of the Property; and
WHEREAS, The City has received from Sam Tsunoda, owner of real
property adj acent to the Property, an offer to purchase the
Property for $160,000.00, which exceeds the appraised fair market
value of the Property; and

WHEREAS, pursuant to Municipal Code Section 2.24.110, real
property may be sold without advertising for bids if the city
Council, by resolution adopted by at least five affirmative votes,
determines that to advertise for bids would be to no avail and
would cause unnecessary expense and delay or would not be in the
best lnterest of the City; and
WHEREAS, appropriate recreation and housing agencies have been
notified of the availability of the Property but have no use for
said Property; and
WHEREAS, on December 12, 1990, the city council approved in
concept the sale of the Property to Sam Tsunoda;
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SANTA MONICA
DOES RESOLVE AS FOLLOWS:
SECTION 1. Public advertising for bids of the Property
described in section 2 of this Resolution is hereby waived because
the adjacent property owner has made an offer for purchase of the
property at a price in excess of the full fair market value, and to
advertise would cause unnecessary expense and delay, would be
unlikely to bring a higher purchase price and would not be lTI the
best interest of the City.

SECTION 2. Subject to complying with all applicable
provisions of State and local laws, the City Manager is hereby
authorized to sell the Property described below to Sam Tsunoda for
the sum of $160,000.00. The sale of the Property shall be subject
to all conditions set forth in the Purchase Agreement. Said
Property is described as follows:
That portion of Olympic Boulevard in the city of Santa Monica,
County of Los Angeles, state of california, relinquished by the
State of California to the said City per deed recorded on March 28,
1966 in Book R2523, Page 769, of official records of said county;
said land also being portions of Lots 5,7,9, and 11, Block 20
Erkenbrecher Syndicate Santa Monica Tract, as shown on map flIed in
Book 6, Pages 26 and 27, of Maps, in the office of the Recorder of
sald County, within the following described boundaries:
Commencing at the most westerly corner of said Lot 9; thence
along the southwesterly line of said lot, South 44042' 53"
East, 26.59 feet to a point on the southwesterly line of said
lot, said point being the True Point of Beginning; thence
continuing along the southwesterly line of said Lot, South
4404215311 East, 11. 00 feet to the beginning of a tangent curve
concave to the north having a radius of 10.00 feet, thence
northeasterly along said curve through a central angle of
75059'59" a distance of 13.26 feet; thence North 59017'08"
East tangent to said curve 12.81 feet; thence to the beginning

of a non-tangent curve concave to the northwest and having a
radius of 795.00 feet, a radial of said curve to said point
bears North 69045'55" West, thence northeasterly along said
curve through a central angle of 3030'32" a distance of 48.69
feet; thence North 16043'32" East tangent to said curve 89.71
feet; thence North 13059'35" West 15.49 feet; thence North
44042142" West 25.14 feet; thence South 16043'32" West 115.06
feet to the beginning of a tangent curve concave to the
northwest and having a radius of 765.00 feet; thence
southwesterly along said curve through a central angle of
4006140" a distance of 54.89 feet, more or less, to the True
Point of Beginning.
SECTION 3.
The City Manager is authorized to execute all
instruments and do all things necessary to effectuate the sale.
SECTION 4. The City Clerk shall certify the adoption of this
Resolution, and thenceforth and thereafter the same shall be in
full force and effect.
