RESOLUTION NO. 7570 (CcS)

A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF SANTA MONICA FINDING THE PUBLIC CONVENIENCE
AND NECESSITY REQUIRE STREET RESURFACING AND
CONSTRUCTION OF GUTTERS IN ACCORDANCE WITH
RESOLUTION OF INTENTION NO. 7545 (CITY COUNCIL
SERIES)
WHEREAS, the city council of the city of Santa Monica,
on the 26th day of January, 1988, passed and adopted its
Resolution of Intention, being Resolution No. 7545 (CCS),
declaring its intention to order the work described therein to be
done, which said Resolution of Intention duly and legally was
published as required by law and notice of said improvement has
been given in the manner required by law and all written
objections and protests to the proposed work or the extent of the
district to be assessed were heard and considered by the city
Council; and
WHEREAS, a public hearing has been held duly and
regularly pursuant to Resolution No. 7545 (CCS) and the laws and
Constitution of the State of California on the proposed street
resurfacing, construction of gutters, planting of trees and
appurtenant work thereto, as described in the Resolution of
Intention No. 7545 (CCS) on Pico Boulevard between 28th Street
and East city Limits; and
WHEREAS, said improvement has been considered fully,
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SANTA
MONICA DOES RESOLVE AS FOLLOWS:

SECTION 1. The public interest and convenience require,
and the City council of the City of Santa Monica hereby orders,
the work described in Resolution of Intention No. 7545(CCS) to be
done on pico Boulevard between 28th Street and East City Limits
within the city of Santa Monica.
Any and all of said protests
and objections of every kind and nature to the proposed work or
to the extent of the district to be assessed be, and the same
hereby are, overruled and denied.
SECTION 2. The City Council hereby finds and determines
further that the "special Assessment Investigation, Limitation
and Majority Protest Act of 1931" shall not apply to the making
of said improvements.
SECTION 3. The improvements shall be conducted under the
Improvement Act of 1911, contained in Division 7 of the streets
and Highways Code of the State of California,
and the
Superintendent of streets and the City Attorney presented to the
City Council the Resolution of Intention required by said
Improvement Act to initiate the proceedings for said improvement.
SECTION 4. A Notice Inviting Bids will be published for
two days in the Evening Outlook, a newspaper published and
circulated in said city.
SECTION S. Reference hereby is made to said Resolution
of Intention No. 7545 (CCS) for a description of the work, and
the assessment district, and further particulars.

SECTION 6. The City Clerk shall certify to the adoption
of this Resolution, and thenceforth and thereafter the same shall
be in full force and effect.
