A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF SANTA MONICA ORDERING THE VACATION OF A
PORTION OF A CERTAIN STREET KNOWN AS PICO
PLACE NORTH BETWEEN APPIAN WAY AND 122 FEET
EAST OF APPIAN WAY AND TWO PUBLIC SERVICE
EASEMENTS IN THE CITY OF SANTA MONICA,
CALIFORNIA
THE CITY COUNCIL OF THE CITY OF SANTA MONICA DOES
RESOLVE AS FOLLOWS:
SECTION 1.
The Ci ty Council of the ci ty of Santa
Monica having heard the evidence offered in relation to the
proposed vacation of all of that portion of pica Place North
between Appian Way and 122 feet east of Appian Way described as
follows: A portion of Pico Place North, shown as the Autoway, 18
feet in width, between Appian Way and Ocean Avenue, on the map of
Tract No. 1111, in the City of Santa Monica, County of Los
Angeles, State of California, recorded in Book 17, Pages 154 and
155, of Official Records, in the Office of the County Recorder of
said County, being that portion bounded to the Southwest by the
Northwesterly prolongation, 18.02 feet in length, of the
Southwesterly line of Lot 9 of said Tract, and to the Northeast
by the Northwesterly prolongation, 18.00 feet in length, of the
Northeasterly line of Lot 7 of said Tract, hereby finds from all
of the evidence submitted that the portion of the street above
referred to and proposed to be vacated by Resolution No. 7556
(CCS) is unnecessary for present or prospective street purposes
and is consistent with the General Plan of the city of Santa

Monica. Map No. 4411 entitled "Map Showing Portion of Pico Place
North from Appian Way to 122' Northeasterly and Public service
Easements to be Vacated Under the provisions of the street
Vacation Act of 1941," dated February 23, 1988, is hereby
attached and incorporated into this Resolution.
SECTION 2 . The property owner, his or her heirs,
assigns or successors of any kind whatsoever, in consideration of
the aforementioned vacation, shall dedicate to the City of Santa
Monica a public utility easement on a 6.00 foot by 89.44-foot
strip of land located as follows: A strip of land 6.00 feet in
width, the Northeasterly line of which is the Northeasterly line
of Lot 7 and the 6. 00 foot Northwesterly prolongation of said
line. In addition, the property owner, his or her heirs,
assigns, or successors of any kind whatsoever, shall dedicate to
the owner of the adjacent Drake Hotel, an easement for purposes
of access and refuse removal on the same 6.00 foot by 89.44 foot
strip of land described herein. Such easement shall be limited
in duration to the life of the Drake Hotel. In addition, the
property owner shall bear the costs of relocating the existing
six-inch sewer line that currently services the Drake Hotel, in
accordance with the city's requirements prior to construction.
SECTION 3. Pica Place North between Appian Way and 122
Feet northeasterly of Appian Way and two public service easements
as shown on the above-referenced Map No. 4411 dated February 23,
1988, are hereby vacated.

SECTION 4.
Pursuant to streets and Highways Code
section 83251, the city Clerk shall also cause a copy of this
Resolution to be recorded in the Office of the County Recorder of
the County of Los Angeles. Upon such recording, the vacation
shall be complete.
SECTION 5.
The City Clerk shall certify to the
adoption of this ReSOlution, and thenceforth and thereafter the
same shall be in full force and effect.
