A RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF SANTA MONICA
DECLARING ITS INTENTION TO ORDER
THE VACATION OF A PORTION OF FIRST COURT,
IN THE CITY OF SANTA MONICA, CALIFORNIA
THE CITY COUNCIL OF THE CITY OF SANTA MONICA DOES
RESOLVE AS FOLLOWS:
SECTION 1. The city council of the city of Santa
Monica hereby declares its intention to order the vacation of
that portion of First Court, as shown in Drawing No. 4416 on file
in the Office of the city Engineer, located between Broadway and
Colorado Avenue, shown as an alley in Block 198 of the Town of
Santa Monica Tract, in the City of Santa Monica, County of Los
Angeles, state of California, as per map recorded in Book 39,
Pages 45 et seg. of Miscellaneous Records, in the Office of the
County Recorder of said County, and described as follows:
A strip of land, 20 feet in width, bounded on the Northeast
by the Southwesterly lines of Lots A and B of said Block:
and another strip of land, 10 feet in width, bounded on the
Northeast by the Northwesterly 30 feet of the Southwesterly
line of Lot C of said Block.
SECTION 2. The City Council of the City of Santa
Monica, in vacating said portion of First Court, intends to
reserve and except from said vacation an easement comprised of
portions of Lots C and D and an alley, all in Block 198 of the
Town of Santa Monica, in the City of Santa Monica, County of Los
Angeles, State of California, as per map recorded in Book 39,

Page 45 et. seq. of Miscellaneous Records, in the office of the
County Recorder of said County, and described as follows:
Commencing at the intersection of the northeasterly
line of Lot C with a line parallel with and distant 20 feet
northwesterly, measured at right angles, from the
southeasterly line of said Lot; thence southwesterly along
said parallel line 85.28 feet to the true point of
beginning, being the beginning of a curve tangent to said
parallel line, concave northwesterly and having a radius of
20 feet: thence westerly along said curve, through a central
angle of 48 degrees 11 minutes 23 seconds, an arc distance
of 16.82 feet to the beginning of a tangent curve concave
southeasterly and having a radius of 40 feet; thence
southwesterly and southerly along said last mentioned curve,
through a central angle of 96 degrees 46 minutes 48 seconds,
an arc distance of 67.56 feet to a line parallel with and
distant 10 feet southwesterly, measured at right angles,
from the southwesterly line of said Lot; thence
southeasterly along said last mentioned parallel line, 6.46
feet to the southwesterly prolongation of said line that is
parallel with and distant 20 feet northwesterly from the
southeasterly line of said Lot; thence northeasterly along
said prolongation and said parallel line to the true point
of beginning.
And the southeasterly 20 feet of Lot C of said Block.
And that portion of Lot D of said Block, beginning at
the most westerly corner of said Lot; thence southeasterly
along the southwesterly line of said Lot a distance of 5
feet; thence northerly in a direct line to a point in the
northwesterly line of said Lot distant 5 feet northeasterly
thereon from said most westerly corner; thence southwesterly
along said northwesterly line to the point of beginning.
SECTION 3. Said easement is for the purpose of
constructing, maintaining, operating, replacing, removing and
renewing all sanitary sewers, water mains and other public
utility facilities and appurtenant structures. The City Council
of the City of Santa Monica finds that public convenience and
necessity require such reservation.

SECTION 4. The City council of the City of Santa

Monica shall allow for the right of the fee owner to encroach on
the subsurface of that portion of the easement described above
which lies within the northwesterly 30 feet of Lot C in Block 198
of said map.
SECTION 5. The City Council of the City of Santa
Monica, in vacating the above-mentioned portion of First Court
elects to proceed under and in accordance with the provisions of
the PUblic Streets, Highways and Service Easements Vacation Law,
streets and Highways Code Section 8300 et seq.
SECTION 6. The City Clerk is hereby directed to
pUblish this Resolution in the Evening Outlook on two successive
dates, the first publication is to be made not less than fifteen
days prior to the date of the public hearing.
SECTION 7. The hour of 7:30 p.m. of the 26th day of
April 1988, in the City council Chambers of city Hall, Santa
Monica, California, be, and the same hereby, is fixed as the time
and place when and where all persons interested in or objecting
to the proposed vacation may appear before the City Council and
offer evidence in relation thereto.
SECTION 8. The Superintendent of Streets of the City
of Santa Monica hereby is directed to cause Notices of street

vacation to be posted as required by street and Highways Code
section 8323.
SECTION 9. The City Clerk shall certify the adoption
of this Resolution, and thenceforth and thereafter the same shall
be in full force and effect.
