RESOLUTION NO 9462 (CCS) (CITY COUNCIL SERIES) AMENDMENT TO THE MEMORANDUM OF UNDERSTANDING BETWEEN CITY OF SANTA MONICA, CALIFORNIA AND SANTA MONICA FIREFIGHTERS, LOCAL 1109, IAFF WHEREAS, the term of the current Memorandum of Understanding between the City of Santa MOnica and the Santa MOnica Firefighters, Local 1109, IAFF (Local 1109) does not expire until June 30, 2000 and WHEREAS, the City of Santa MonIca and Local 11 09 wish to modify Sections 3 01 and 4 01 of thIs Memorandum of Understanding effectIve as of July 1, 1998, NOW, THEREFORE, both parties to the Memorandum of Understanding between the City of Santa MOnica and Local 1109 agree to modify the eXisting Memorandum of Understanding to make the follOWing revIsions to subsection A (Medical Insurance) of Section 301 (Health Insurance) and subsection F of Section 402 (Vacation) Section 301 Health Insurance The fifth full paragraph of subsection A IS hereby deleted In Its entirety It IS hereby replaced With the follOWing language to read 1 . . In addition, each month the City shall contnbute on behalf of each eligible employee toward a cafeteria plan the lesser of (I) $459, which IS the City's medical Insurance contnbutlon cap of $475 per month less the $16 per month contnbutlon to PERS, and (II) the difference between (a) the composite monthly Insurance premium as calculated In the third paragraph ofthls Section 3 01 and (b) the $16 contnbutlon set forth In the fourth full paragraph of this Section 301 Each eligible employee shall have the right to elect medIcal coverage from those avaIlable under the Public Employees Medical and Hospital Care Act (PEM and HCA) Each eligible employee can use this City contnbutlon to cover all or a portion of the cost of medical Insurance for the employee and his/her eligible dependents under one of the PERS Program options Irrespective of the actual cost of medical coverage under the PEM and HCA, the cost of each option under the PERS program (the "PERS Program Option") IS the monthly composite medical Insurance premium defined In the third full paragraph of this Section 3.01 plus $110 In the event the cost of the PERS Program option IS greater than the sum of the (1) City'S contribution to the cafetena plan pursuant to thiS paragraph and the $16/month contributIon to PERS, the difference shall be paid through one of the follOWing two arrangements selected by Local 1109 (a) payment to first be made from the employee's 125 Plan account with any additional payments required to be made by direct payroll deduction by each employee or (b) direct payment by Local 11 09 Any tax liability associated wIth the contnbutlon made by the City to the cafeteria plan shall be paid by the employee upon whose behalf the contnbutlon to the cafeteria plan IS made Pursuant to the terms of the cafeteria plan, an employee who IS fully covered by his/her spouse's health Insurance plan, may elect not to 2 . . receive medical coverage pursuant to the options available under PEM and HCA and shall be entitled to a cash payment equal to the City contnbutlon to the cafeteria plan on hIs/her behalf An employee who chooses this cash payment option must provide proof of full coverage under his/her spouse's health Insurance plan The parties agree that the limitation set forth herein to receive the cash payment option (I e , that the employee must be fully covered by his/her spouse's health Insurance) IS sufficient to aVOId inclusion ofthe cash payment In the FLSA regular rate of the employee as set forth at 29 C F R 9778 215(a)(5) SectIon 4 02 (VacatIon) Subsection F IS hereby deleted In ItS entirety Subsection F IS hereby replaced with the following language to read F Each employee may accumulate vacation leave to a maximum of three (3) times the employee's annual accrual rate Except as expressly modrfied herein, all other terms and conditions set forth In the Memorandum of Understand Ing between the City of Santa MOnica and Local 1109 shall remain In full force and effect IN WITNESS WHEREOF, the parties have executed this Amendment to the Memorandum of Understanding between the City of Santa MOnica Local 1109 as of the 3 . . date of the adoption of this modification by City Council SANTA MONICA FIREFIGHTERS LOCAL 1109, IAFF CITY OF SANTA MONICA By L Stis~cfulTt1lY\J( CIIy Manager ~ 'I ~-?4f"~ A: ;?/'&$- ~orge Menta, President -- G~ t-1~~ Dan Matthies,' Vice President APPROVED AS TO FORM ~,., /1 J -? /1 ----< __~ f~ ',f/t#::- L -( /.JeJJ<---~-v- Dlr~ Bailey, Board of Dlrect6rs ~~~~ City Attorney ~-I^--.
