A RESOLUTION OF INTENTION TO APPROVE AN AMENDMENT TO CONTRACT
BElWEEN THE BOARD OF ADMINISTRATION
OF THE PUBLIC EMPLOYEES' RETIREMENT SYSTEM
AND THE CITY COUNCIL OF THE CITY OF SANTA MONICA
WHEREAS, the Public Employees' Retirement Law permits the participation of
publiC agencies and their employees In the Public Employees' Retirement System by the
execution of a contract, and sets forth the procedure by whIch said public agencies may
elect to subject themselves and their employees to amendments to saId Law, and
WHEREAS, one of the steps In the procedures to amend this contract IS the
adoption by the governing body of the public agency of a Resolution giving notice of Its
intention to approve an amendment to said contract, which Resolution shall contam a
summary of the change proposed In said contract, and
WHEREAS, the following IS a statement of the proposed change
To proVide Section 21573 (Third Level of 1959 Survivor Benefits) for local
miscellaneous members
NOW, THEREFORE, BE IT RESOLVED THAT THE CITY COUNCIL OF THE CITY
OF SANTA MONICA does hereby give notice of intention to approve an amendment to the
contract between saId public agency and the Board of AdminIstration of the Public
Employees' RetIrement System, a copy of said amendment being attached hereto, as an
"Exhibit" and by thiS reference made a part hereof

DISCUSSION
The CIty of Santa Monica contracts with CalPERS to provide a retirement plan for Its
permanent safety (police and fire) and miscellaneous (non-safety) employees As a
contracting agency, the City may amend Its contract(s) to provide various optional benefits
offered by CalPERS
The 1959 Survivor Benefit option IS an additional CalPERS benefit which contractmg
agencies can offer to employees who are not covered by SOCial Secunty The 1959
Survivor Benefit option IS modeled after the SOCial Security program In that It proVides a
monthly benefit to the families of CalPERS members who die pnor to retirement
As SOCial Secunty benefits Improved over the years, CalPERS has modified the 1959
Survivor Benefit option by prOViding additional benefit levels The ThIrd Level proVides a
higher monthly payment to the CalPERS member's family than that which IS proVided by
the baSIC program
As a part of the most recent Memorandum of Understanding (MOU) negotiated between
the CIty of Santa MOnica and the MUniCipal Employees ASSOCiation, the City agreed to
amend ItS contract With CalPERS to proVide Section 21573 Third Level of 1959 Survivor
Benefits DOing so requires that the benefit apply to all local miscellaneous members,
which mcludes all non-safety City employees

The City Clerk shall certify to the adoption of this Resolution, and thenceforth and
thereafter the same shall be In full force and effect
