COMMUNITY AND CULTURAL SERVICES'KK \RESOLFAC B Council Meeting of June 22, 1999 Santa MOnica, CalIfornIa RESOLUTION NO. 9410 (CITY COUNCIL SERIES) A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA MONICA DECLARING ITS POLICY FOR THE USE OF THE CIVIC AUDITORIUM AND COMMUNITY AND RECREATIONAL FACILITIES OPERATED BY THE COMMUNITY AND CULTURAL SERVICES DEPARTMENT OF THE CITY OF SANTA MONICA AND FOR THE CHARGING OF FEES FOR USING SAME. WHEREAS, the facIlitIes of the Community and Cultural ServIces Department are for use by the public, and WHEREAS, access to the facllltfes should be available to all people without dlSCnmlnatlon as to race, age, religion, gender, sexual onentatlon, mantal status, disability, natIonal origin, or economic status, and WHEREAS, In determinIng polIcy with regard to the use of communIty and recreatIonal faCilities, pnmary consIderation should be gIven to meet the needs of the people of Santa MonIca, ItS organizations and programs, and WHEREAS, pnvate individuals and groups making use of limIted public facIlities are expected to pay theIr proportIonate share of the cost of operating, maIntaInIng and constructing such facilities, NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SANTA MONICA DOES RESOLVE AS FOLLOWS SECTION 1 PermIts for recreational bUildings (excluding Pohce Activities League and Miles Memonal Playhouse) shall be granted according to the pnorlty usage categories listed below 1 CIty of Santa MonIca Events/Meetlngs/Pro~rams The City of Santa Monica offers a range of community service, recreation programs and -25- . . specIal events to the public The majorIty of these programs are offered by the Department of Community and Cultural Services Programs and meetings of City departments, diVIsions, boards and commISSions have pnonty use of the City's recreational bUildings Rental fees are not applicable 2 CollaboratIve City/CommunIty Pro~rams ThIS category consists of programs or services that meet mutual goals to serve the public or speCIal user groups and are offered JOintly by the City of Santa MOnica and a Santa MonIca-based communIty group or agency Program deSign, schedul I ng for the program, and outreach IS done In a collaborative way There IS an ongoIng relatIonship between CIty staff and the community group or agency including an assessment of the program Rental fees are waived for collaboratIve programs 3 SponsorshIp by the City Sponsorship Involves an agreement by the CIty to support an endeavor of a community organization or group that fIlls a program need In the communlty While the City may partiCIpate In program or event plannIng, the major direction comes from non-City staff or organIzatIons The CIty may assist WIth marketing, and even some staffing at an event, but IS not Integrally Involved In (a) whether the event/program WIll take place, (b) ensunng total fundIng, (c) scheduling, and (d) program deSign and evaluation Insurance as determined by the City's Risk Manager may be requIred For fee schedule information reference ExhIbit A Organlzatlons elIgible for a rental fee waiver are educational InstitutIons or City funded non-profit organizatIons 4 Santa MOnica based Non-Profit Groups/OrganizatIons Santa MonIca has a WIde network of non-profit organizatIons WIth 501 (c)3 or 501 (c)4 non- profit status These groups proVide a range of human serVices, education and recreational programs and events to Santa MonIca reSidents They may serve the general publiC or speCial user groups such as seniors, youth, or persons With dIsabilitIes These programs -26- . . may be free, or attendees may pay a fee for servIce, a membership fee or a voluntary donatIon To be In this user category, applicants must submit documentatIon of their tax- exempt status ThIs category also Includes governmental agencIes Fund raisIng events by these organIzatIons are consIdered "Commercial Meetings/Events" as descnbed In SectIon 1 10 Insurance as determined by the City'S RIsk Manager may be required For fee schedule represent a neighborhood WithIn the CIty shall have the rental fee waIved for up to 300 hours of meetmg space use per fiscal year In recreational bUildings or Ken Edwards Center (b) The rental fee shall be waived for Non-profIt Organizations WIth 501 (c)3 or 501 (c)4 status whose permanent address IS located In the City of Santa Monica, and whose normal place of operation or services IS located In the City of Santa MOnica, and proVIdes a range of recreational programs or events, social actIvitIes, human services or educational opportunities for Santa MonIca's youth eighteen years of age and under 5 Santa MOnica-based CommunIty Events and Meetlnps IndiVIdual reSIdents or more Informal community organIzations that do not have tax-exempt non-profit status but provIde community servIces or CItizen particIpation opportunIties to Santa MOnica reSidents are In thIS category These events may be meetings, socIal events or educational or recreatIon actIvitIes Programs are either offered free SECTION 8 Section 6 of ResolutIon Number 3579 (GGS) IS hereby deleted In Its entirety and replaced by the following language SECTION 6 PARKING LOT The City reserved the right to maintain and operate the Auditorium parking lots located within the area under the supervIsion and control of the DIrector CIty may contract with a person, or persons, for the pnvate operatIon of saId parking lots on a flat monthly basIs or on a percentage of gross receipts derived from all sources from such operatIon AvaIlable parking space may be rented at a fee not to exceed SIX Dollars ($600) per automobile space per period of occupancy, not to exceed twelve (12) hours Parking for AuditOrium events shall have precedence over parking for the general public, Including city employees NotwIthstanding any provIsions herein contaIned, City may grant free use of said parkIng lots to the general public SECTION 9 Except as modifIed by this ResolutIon, all other terms and conditions of Resolution Number 3579 (CGS) shall remain In full force and effect SECTION 10 Resolution Number 8171 (CCS) IS hereby repealed In ItS entIrety SECTION 11 The CIty Clerk shall certify to the adoptIon of this Resolution, and thenceforth and thereafter the same shall be In full force and affect APPROVED AS TO FORM X~i? ~ ( MJrsh~ J~~~outrle ~ty Attorney -34- . .
