Finance RB DC F \FINANCE\TREAS\SHARE\FEESST98\FEERESO City Council Meeting 6/22/99 Santa MOnica California RESOLUTION NO 9408 (CITY COUNCIL SERIES) A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA MONICA REVISING CURRENT USER FEES AND SETTING NEW USER FEES FOR SERVICES PROVIDED BY VARIOUS CITY DEPARTMENTS WHEREAS, the City of Santa MOnica recently completed a comprehensive analysIs of user fees charged by vanous departments for the purpose of updating fee amounts and thereby preserving public financIal resources, and WHEREAS, It was determined that In many cases, the fees charged by the City do not reflect the full costs Incurred In the provIsion of the related services, and WHEREAS, It IS the general policy of the City of Santa MOnica to charge for the full costs of servIces provIded by City staff when the services benefit individual users rather than members of the community as a whole, and WHEREAS, Ordinance No 1754 (CCS) (the "Ordinance"), adopted July 12, 1994, governs the settIng of the amount of user fees or fees for servIces provided to or for the benefit of partIcular mdlvlduals rather than the general public; and WHEREAS, the Ordinance allows such user fees or fees to be set by ordinance, by a resolutIon adopted by the City CouncIl, or by any other means authonzed by law, -1- . . NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SANTA MONICA DOES RESOLVE AS FOLLOWS SECTION 1 Pursuant to Ordinance No 1754 (CIty Council Senes), Resolutions Number 7607 and 8770 (City CouncIl Senes), and Section 1 of Resolution Number 8866 (CIty CouncIl Serres) are hereby amended to revise eXisting fee rates for various user services as set forth In Attachment A to thiS Resolution SECTION 2 The follOWing new EnVironmental and Public Works Department fees are established ENCROACHMENT PERMIT- NON COMMERCIAL - For applicatIon by the owner of a non-commercIal property for a permIt to use public property for permanent structures, a fee of one hundred dollars ($10000) per permit IS established OTHER RIGHT OF WAY INQUIRIES/RESEARCH - For various research and report services conducted by EnVironmental and Public Works Department staff not mcluded In other fees, a fee collected on a time and material baSIS to recover actual City costs to provIde the service IS established SECTION 3 The follOWing Fire Department fees are established for permit categones listed In the Umform Fire Code and as noted In Attachment A to thiS Resolution TIRE STORAGE - For a permIt to operate a tIre store, a fee of sixty four dollars and 60 cents ($64 60) IS established -2- . . UFC PERMITS/OTHERS - For other plan revIew and/or permits related to categones noted In the Uniform FIre Code (UFC), a fee of slxty-one dollars ($61 00) IS establrshed PYROTECH/FLAME/SFX - For a permit to allow the use of pyrotechnics and special effects at movie and teleVIsion shoots, a fee of one hundred twenty nine dollars and eIghty three cents ($12983) IS established LIVE AUDIENCE - For a permIt to allow live audiences to be In attendance at a production facIlity dUring a movie or teleVISIon shoots, a fee of sixty four dollars and seventy three cents ($64 73) IS established APPROVED PRODUCTION FACILITIES - For a permit to allow a production facilIty to eXIst, a fee of one hundred ninety four dollars and twenty cents ($194.20) IS established SPECIAL INSPECTIONS - For Inspecftons, plan reVIews, and tests conducted after normal business hours, a fee of four hundred twenty SIX dollars ($426 00) IS established ALTERNATE METHODS - For evaluation of plans proposing alternate means and methods of satisfying the Intent of the UFC while not exactly matchIng UFC requirements, a fee of four hundred forty eight dollars and eIghty cents ($448 80) IS establIshed WRITTEN RESPONSES - For research and report preparation for bUSinesses requesting a copy of a fire report, a fee of two hundred seventy eight dollars and forty eIght cents ($278 58) IS established -3- . . SECTION 4 For conducting research for members of the public regarding City Issues by the City Clerk's office, a fee of $25 00 per hour IS established SECTION 5 The following Planning and Community Development Department fees are established CODE COMPLIANCE CHECK - For Planning DIVIsion review of applicable development projects for conformance to the Santa MOnica MunIcIpal Code, a fee of five hundred ten dollars ($51000) ARB STAFF APPROVAL - For staff review and approval certaIn development- related Items that fall under the authonty of the Architectural ReView Board, a fee of one hundred eighty four dollars ($18400) IS established SECTION 6 For the processIng of checks for CIty servIces that have been deposited by the City and returned unpaid by a financIal institution, a fee of twenty-fIve dollars ($25 00) per returned check IS established SECTION 7 Beginning July 1, 2000 and on July 1 of each fiscal year thereafter, all fees established by thiS ResolutIon shall be administratively reVised by a factor equal to the difference In the Los Angeles-Rlverslde-Orange County Consumer Price Index for the twelve month penod February through February of the prior fiscal year No later than January 1,2004 and at five year Intervals thereafter, the City Will conduct a comprehenSive study of all fees set by thIS Resolution to determine If fees charged adequately recover City costs for these services, and the results of the -4- . . comprehensive study shall be reported to the CouncIl SECTION 8 The fees set forth In thIs ResolutIon with the exceptIon of Planmng and Community Development Department fees shall be effective July 1, 1999 PlannIng and Community Development Department fees shall be effective September 1, 1999 SECTION 9 The CIty Clerk shall certify to the adoption of this Resolution, and thenceforth and thereafter the same shall be In full force and effect APPROVED AS TO FORM.
