A RESOLUTION OF INTENTION OF THE CITY COUNCIL OF THE CITY OF
SANTA MONICA TO SET PUBLIC HEARINGS ON MAY 26, 1998 AND
JULY 14,1998 FOR THE PURPOSE OF DETERMINING WHETHER OR
NOT THE PUBLIC CONVENIENCE AND NECESSITY REQUIRE THE
CONSTRUCTION OF CONCRETE GUTTERS, STREET RESURFACING,
SIDEWALKS, DRIVEWAYS, SIDEWALK/DRIVEWAYS, CURB REPAIRS,
RESTORATION OF PARKWAYS, AND APPURTENANT WORK, IN
CONJUNCTION WITH THE FY 1997-98 STREET RESURFACING
PROGRAM
WHEREAS, the City Council of the City of Santa MOnica proposes to InitIate
proceedings under the RIght to Vote on Taxes Act (Proposition 218), the MunIcipal
Improvement Act of 1911, and the Government Code for the construction of concrete
gutters, street resurfacing, repaIr of damaged SIdewalks, dnveways, sidewalk/driveways
and curbs, and the restoration of parkways, and
WHEREAS, Section 19 of Article XVI of the California Constitution provides that
certain specIfied debt limitation and majority protest provIsions shall not apply If, after the
giVing of reasonable notice by publication and mailing and the holding of a public hearing
as prescnbed by the CIty Council of the City of Santa Monica, the City Council, by no less
than four-fifths vote of all of ItS members, finds and determines that the public convenience
and necessIty reqUire the proposed Improvements to be made, and

WHEREAS, Streets and Highways Code Section 2804 provides that the "Special
Assessment, Investlgatlon, LImitation and MaJorrty Protest Act of 1931" shall not apply to
any proceeding otherwise subject thereto when the Improvement proceeding IS by a
charter city and the City has complred with the provIsions of Section 19 of Article XVI of the
California Constitution, and
WHEREAS, the City of Santa MOnica IS a Charter City of the State of Callforma,
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SANTA MONICA
DOES RESOLVE AS FOLLOWS
SECTION 1 The CIty Council proposes to Imtlate proceedings for the constructIon
of concrete gutters, street resurfacing, repaIr of damaged Sidewalks, dnveways
sldewalk/dnveways, and curbs, restoration of parkways, and appurtenant work adjacent
to reSidential and non-residential properties on City streets as follows

SECTION 2 The total estimated cost of the proposed Improvements IS three
million, seven hundred thousand dollars ($3,700,000) The total of assessments IS
estimated to be SIX hundred twenty-seven thousand, eight hundred thIrty-one dollars
($627,831)
SECTION 3 The Improvements and repairs shall be conducted pursuant to the
Mun IClpal Improvement Act of 1911, which IS contained In DIvIsion 12 of the Streets and
Highways Code of the State of CalifornIa and the Right to Vote on Taxes Act (Proposltron
218)
SECTION 4 The criteria used to determine which streets are to be resurfaced and
the method of repair Include age, surface and subsurface conditions, complaints receIved,

type of use (I e , commercial, Industnal or reSIdential), current traffic volume, and projected
change of use or traffic volume The proposed work or Improvements In the opinion of the
City CouncIl of the Crty of Santa MOnica are of more than local or ordinary public benefit,
and the City Council hereby proposes that the cost of the assessment shall be as follows

SECTION 5 Payments on the prrnclpal of unpaid assessments and Interest
shall be made by property owners to the City Treasurer and the same shall be dIsbursed
by him/her or as provided In the "Mumclpallmprovement Act of 1911 II
SECTION 6 Parcels owned by non-profit orgamzatlons which can
demonstrate that the orgamzatlon receives a welfare exemption from the Los Angeles
County Assessor shall be exempt from this assessment
SECTION 7 Notice IS hereby given that on Tuesday, the 26th day of May,
1998, and Tuesday, the 14th day of July, 1998, at 630 PM, In the City Council Chambers
located In City Hall, 1685 Main Street, Santa MOnica, Callforma, there shall be public
hearings before the City Council for the purpose of determining whether the public
convemence and necessity reqUire the above-described Improvements and for the purpose
of allowing any and all persons haVing any obJectlons to the proposed work or
Improvements to appear and show cause why the proposed work or Improvements should
not be carried out In accordance With this Resolution of Intention InqUiries concerning the
public hearings should be directed to the Department of EnVironmental and Public Works
Management, DIVISion of Englneenng, at (310)458-8721 or the City Clerk's office, at
(310)458-8211

SECTION 8 The City Clerk shall give notIce of the heanngs by publication
as hereinafter proVided Any Interested person may file a protest against the proposed
work or Improvements In writing with the CIty Clerk at any tIme not later than the hour set
for the first public heanng In the manner set forth In the Streets and Highways Code
Section 5220 Property owners may also vote on the assessment dIstrict by submItting
ballots before the close of the first public heanng
SECTION 9 CIty Staff IS dIrected to mall notIces of the adoptIOn of thIs
Resolution and ballots, pursuant to Government Code SectIon 54954 6, to all persons
oWning property In the assessment district desCribed above, whose names and addresses
appear on the last equalized assessment roll for the City taxes or as known to the office
of the City Engineer
SECTION 10 The City Clerk IS directed to publish this Resolution, In
accordance with Government Code Section 6066, In a newspaper of general CIrculation
once a week for two weeks With at least five days Intervening between the first date and
second date of publication The first publication IS to be made not less than 45 days prior
to the dates of the above publiC hearings
SECTION 11 Pursuant to Public Contract Code Section 20433, the City
Council hereby finds that It IS not In the public Interest to allow property owners to contract

for the street resurfacing and gutter construction and thereby the City shall be responsible
for awarding and administering the construction contract for this district
SECTION 12 The City Clerk shall certify to the adoption of this Resolution,
and thereafter the same shall be In full force and effect
