R-9389 . . g:\atty\muni\laws\mJm\pchpgrant res City Council Meeting: 4-27-99 Santa Monica, Califorma RESOLUTION NUMBER 9389 (CCS) (City Council Series) A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA MONICA AUTHORIZING SANTA MONICA POLICE DEPARTMENT PARTlelPA TION IN A MULTI-AGENCY TASK FORCE SPONSORED BY THE CALIFORNIA HIGHWAY PATROL (CHP) FOR THE PURPOSE OF INCREASING TRAFFIC ENFORCEMENT ALONG THE PACIFIC COAST HIGHWAY CORRIDOR AND RECEIVING GRANT FUND REIMBURSEMENT FOR THE COSTS OF THE INCREASED ENFORCEMENT WHEREAS, grant funds are available for Fiscal Year 1998/1999 and Fiscal Year 1999/2000 from the Califorma Highway Patrol (CHP) State Route (SR) -1 Traffic Safety Corridor Project for the purpose of increasing traffic enforcement along that part of the Pacific Coast Highway corridor in the City of Santa Momca, and WHEREAS. this purpose can best be served in Santa Momca by seeking reimbursement from the California Highway Patrol for those overtime salary costs directly related to the increased traffic enforcement occurring along Pacific Coast Highway in the City of Santa MOnica, NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SANTA MONICA DOES RESOLVE AS FOLLOWS: SECTION 1. The City CounCil authOrizes the City Manager, or his or her designee, to negotiate and enter mto a participation agreement with the California Highway Patrot for the reimbursement of salary costs related to the Increased traffic enforcement along the 1 . . Pacific Coast Highway corridor in the City of Santa Momca In an amount not to exceed the amount of the grant funds authorized by the Califorma Office of Traffic Safety under the State Route (SR) -1 Traffic Safety Corndor Project. SECTION 2. The City of Santa Momca acknowledges and resolves that any liability ansing out ofthe performance ofthls Participation Agreement with the California Highway Patrol, Includmg cIvil court actions for damages, shall be the responsibility of the end reCipient and the authorizing agency and that the State of California, the California Office of Traffic Safety, and the California Highway Patrol disclaim responsibility for any such liability SECTION 3. The City further acknowledges and resolves that the grant funds received as reimbursement shall not be used to supplant expenditures controlled by this body SECTION 4.
