A RESOLUTION OF THE CITY COUNCIL OF
THE CITY OF SANTA MONICA ORDERING THE
VACATION OF EXCESS STREET RIGHT-OF-WAY
LOCATED AT THE SOUTHEAST CORNER OF
DELAWARE AVENUE AND HIGH PLACE
WHEREAS, the C~ty has determined that the real property
described 1n Sect~on 1 and Exhibits nAil and HB" to this Resolution
(the "Property") ~s no longer needed for the purpose acqu1red and
that sa~d surplus parcel ~s not needed for any public use or street
purposei and
WHEREAS, on March 23, 1999, the City Counc~l adopted
Resolut~on No. 9383 (CCS) authorlz1ng sale of the Property to the
adJacent property owner, Samuel Kardash1ani and
WHEREAS, on March 23, 1999, the C~ty Council adopted
Resolutlon No. 9384 (CCS) setting the matter for public hearing and
declaring its intent to vacate the Property in order to complete
the salei and

WHEREAS, on March 24, 1999, notices of the proposed vacatlon
were posted as required by Callfornla Streets and H~ghways Code
Section 8323; and
WHEREAS, a publlC hearing on this matter was held on Aprll 13,
1999, and
WHEREAS, street vacatlon of thlS excess street right-of-way
must be completed before the sale of the Property can be concluded,
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SANTA MONICA
DOES RESOLVE AS FOLLOWS:
SECTION 1.
The Clty Council of the City of Santa Monica
orders vacation of that excess street rlght-of-way located at the
southeast corner of Delaware Avenue and Hlgh Place as depicted ln
Exhibit nAil, Drawlng No. 4579, and more fully descrlbed in the
legal descriptlon set forth in Exhiblt "B". Exhibits "An and "B"
are attached hereto and lncorporated herein by reference.
SECTION 2. In vacatlng sald excess street rlght-of-way, the
City Council of the City of Santa Monica reserves and excepts from
the vacatlon, easements in favor of the Clty and public and prlvate

ut1l1 ty compan1es, and their respective agents, employees, and
representatlves,
for
purposes
of
constructlon,
operation,
ma1ntenance, repair, removal and replacement of all sewer, water,
storm draln, street lights, traffl.c sl.gnals, electrl.cal, gas,
telephone, cable TV and other util1ty faC1ll.t1es and improvements.
SECTION 3
From and after the date thl.s Resolution 1S
recorded, the excess street r1ght-of-way shall no longer constitute
a City of Santa Monl.ca Street.
SECTION 4. Th1S vacatl.on is completed in accordance with the
provl.sl.ons of the California Streets and Highways Code, Part 3,
rrpubl1c Street, Highways and SerVlce Easements Vacation Law II ,
Chapter 3, "General Vacation Procedure".
SECTION 5. Pursuant to Cal1fornia Streets and Hl.ghways Code
Section 8336, the Clty Clerk shall cause a copy of thl.s Resolut1on
to be recorded l.n the office of the County Recorder of the County
of Los Angeles.
