CA:f\atty\mun~\laws\mox\kardash C~ty Counc~l Meeting 03-23-99 Santa Monica, California RESOLUTION NO. 9384 (CCS) (CITY COUNCIL SERIES) A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA MONICA DECLARING ITS INTENTION TO ORDER VACATION OF EXCESS STREET RIGHT-OF-WAY AT THE SOUTHEAST CORNER OF DELAWARE AVENUE AND HIGH PLACE WHEREAS, the City of Santa Mon~ca has determ~ned that the real property (the ItPropertylt) described in Section 1 and the attached Exhibits A and B of this Resolution is no longer needed for the purpose acquired and that said surplus parcel ~s not needed for any publ~c use or street purpose; and WHEREAS, s~nce util~ty l~nes and appurtenant structures are located on, above or beneath the Property, the C~ty Council of the City of Santa Mon~ca will reserve easements in favor of public and pr~vate utility companies and their respect~ve agents, employees and representatives for purposes of construct~on, operat~on, ma~ntenance, repa~r, removal and replacement of all sewer, water, storm drain, street l~ghts, traffic signals, electr~cal, gas, telephone, cable TV and other utility facilities and improvements; and WHEREAS, the sale of the Property to the adJacent property owner~ Samuel Kardashian, has been author~zed; and 1 . . WHEREAS, vacatlon of the Property must be completed before sale of the Property occurs; NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SANTA MONICA DOES RESOLVE AS FOLLOWS: SECTION 1. The C1ty Council of the C1ty of Santa Monica declares 1tS lntent10n to order vacat10n of the excess street right-of-way parcel located at the southeast corner of Delaware Avenue and Hlgh Place deplcted on Exhlb1t "A", Drawing No. 4579 and further descrlbed 1n the legal description set forth ln Exhibit "B", both of whlch are attached hereto and 1ncorporated herein by reference. SECTION 2. The Clty Council of the City of Santa Monica 1n vacat1ng the Property described ln Sectlon 1 of this Resolutlon, elects to proceed ln accordance with the provisions of the Cali fornia Streets and Highways Code, Part 3, "Public Streets, Highways and Servlce Easements Vacation Law", Chapter 3, "General Vacation Procedure". SECTION 3. The hour of 6:30 p.m. on the 13th day of Apr11, 1999, in the temporary CounC11 Chambers located in the Maln Library audltorlum at 1343 6th Street in the Clty of Santa Monica be and the same hereby lS f1xed as the time and place when and where all 2 . . persons interested in or objecting to the proposed vacation may appear before the City Council and offer evidence in relation thereto. SECTION 4. The Director of Environmental and Public Works Management Department is hereby directed to cause notices of street vacation to be posted as required by California Streets and Highways Code section 8323. SECTION 5. The City Clerk of the city of Santa Monica is directed to cause notice of the date, hour and place of the public hearing to be published once a week for at least two consecutive weeks prior to the hearing as required by California streets and Highways Code section 8322. SECTION 6. The City Clerk shall certify to the adoption of this Resolution, and thenceforth and thereafter the same shall be in full force and effect.
