R-9352 . . f \ppd\share\opspacel\mumpool\munlpoolsoc City Council Meeting 12-15-98 Santa MOnica, California RESOLUTION NO ~52 (City Council Senes) A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA MONICA MAKING THE CEQA FINDINGS NECESSARY TO APPROVE THE AMENDMENT TO THE DEVELOPMENT AGREEMENT BETWEEN THE CITY AND THE SANTA MONICA COLLEGE AUTHORIZING THE DEVELOPMENT OF THE MUNICIPAL POOL REPLACEMENT PROJECT, ADOPTING A STATEMENT OF OVERRIDING CONSIDERATIONS, AND ADOPTING A MITIGATION MONITORING PLAN WHEREAS, the City Council has certified an Environmental Impact Report for the Santa MOnica Municipal Pool Replacement Project, NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SANTA MONICA DOES HEREBY RESOLVE AS FOLLOWS SECTION 1 Consistent with Article VI, Section 12 of the City of Santa Monica CEQA GUidelines and Sections 15091 and 15092 of the State of California CEQA GUidelines, the City Council finds that most Impacts resulting from the project can be reduced to an acceptable level There are no Significant Impacts Identified for artifiCial light, shade/shadow, aesthetiCS, police protection, construction Impacts, and neighborhood effects In addition, the Significant environmental effects, In the areas of air quality and nOise, as Identified In thiS Section below, can feaslblely be eliminated or substantially reduced to below a level of Significance Finally, as detailed In Section 2, mitigations are 1 L ;'. r .~ \It . . recommended for the remaining unavoIdable sIgnifIcant effects In the areas of traffIc. However, these Impacts cannot feaslblely be avoided or mitigated to below a level of significance Nevertheless, these unavoidable impacts are found to be acceptable due to overriding considerations as discussed m Section 5 (a) The final EIR determmed that Without mitigation, the project could have a potentially significant effect on air quality dunng construction ConstructIon Impacts related to air quality would be reduced to a level of Inslgnrficance Consistent With Article VI, SectJOn 12 of the City of Santa Monica CEQA GUldelmes and Section 15091 of the State CEQA GUidelines, the City Council fmds thatthe followmg mitigation measures which have been reqUired m the project will mitigate or reduce the construction Impact of the project on air quality to below a level of significance (1) Contractors shall use water or other effective dust control measures to reduce fugitive dust emissions (2) Frequent site clean-up near the access dnveway shall be performed to prevent track-out of dirt that could be pulverized by passing cars (3) DUring construction the maximum practical distance buffers between seml- stationary on-site equipment such as generators, compressors, etc and the nearest pollution-sensitive uses at homes across 16th Street and mstructlonal class rooms shall be maintained (4) Construction related SOil disturbance actiVities shall be terminated dunng Santa Ana Wind conditions, or use continuous watering for dust abatement (b) The final EIR determined that Without mitigation, the project could result In Significant nOise Impacts which could Impact surrounding uses Consistentwlth Article IV, Section 12 of the City of Santa MOnica CEQA GUidelines and Section 15091 of the State 2 _)110 .... lUG . . CEQA GUidelines, the City CouncIl finds that the following mItIgatIon measures whIch have been required In the project will mitigate or reduce the nOise Impacts of the project to below a level of sIgnificance (1) A nOise barrier of no more than 18 feet In heigh, measured from eXisting grade shall be constructed to break allllnes-of-slght between the project site and residences to the west In addition to extending along the western boundary of the SIte, the barner shall be located along the southern boundary The pedestrian entrance shall be designed With either a baffle (overlapped) panel or constructed to wrap around the northern edge of the Side until no line-of-slght relationship remainS to any residence west of 16th Street (2) No sWim Instructional activities InvolVing the use of attention-getting devices such as whIstles, bull-horns, shouting, etcetera, shall occur before 7 a.m on weekdays or 8 a.m on Saturday or Sunday (3) Gates shall remain closed on sWim meet days until 8 a m to deter early arnval or practice (4) No amplified sound or musIc shall be used before 9 a m. or after 7 p m. unless use of such equipment can be demonstrated to be inaudible at the closest reSidences SECTION 2 ConsIstent With Article VI, Section 12 of the City of Santa MOnica CEQA GUidelines and Section 15091, 15092, and 15093 of the State of California CEQA GUidelines, the City Council finds that the Significant environmental effects as Identified below can be reduced but cannot feaslblely be aVOided or mitigated to below a level of slgmflcance Nevertheless, these Impacts are found to be acceptable due to overrldmg conSiderations as discussed In Section 5 (a) The final EIR determined that Without mitigation, the project would result In a Significant neighborhood Impact due to Increased traffiC on Pearl, 14th and 16th Streets that 3 ~,~ ~1LJ-= . . could not be mitigated The additional tnps, both cumulative and those generated by the project would result In 0% Increase for Pearl Street 03% Increase for 14th Street and 0 1 % Increase for 16th Street Consistent with Article IV, Section 12 of the City of Santa MOnlca CEQA GUidelines and Section 15091 of the State CEQA GUidelines, the City CounCIl finds that the following mitigation measures which have been required In the project will reduce the Impact of the project on traffiC, but not to a level of inslgnlficance (1) In order to accommodate the net parking Increase due to Increased usage, the college shall deSignate a minimum of 24 spaces which will be available to pool users dunng peak hours (3'30-5 30 p m on weekdays and Saturdays) The 24 spaces shall be located In either Parking Structure A or C The precise location shall be determined In a JOint Operating Agreement entered Into between the City and the Dlstnct (2) To discourage weekend pool users from parking on nearby residential streets, the City shall encourage weekend users to park In SMC off-street parking faCIlities through informational programs (bulletin board notices, mailer Inserts, etcetera) (3) The ninety-sIx parking spaces currently located on Parking Lot 8 which Will be lost due to the construction of the MUniCipal Pool faCility shall be replaced Until October 31, 1999, these replacement spaces Will be located at either the City's beach or airport lots The speCifiC reqUirements governing the use of the beach or airport lots, Including parking location and schedule, shall be established In the JOint Operating Agreement After October 31, 1999, the replacement spaces shall be prOVided on the College campus (4) Information concerning appropriate bus routes shall be proVided to sWim team bus dnvers In advance of any SWim meets Bus routes shall aVOid residential streets to access the site To minimize drop-off/plck-up actiVity along 16th Street, team buses shall be requ Ired to d rop-off/plck-up sWim meet participants along the PICO Boulevard frontage of the College (5) To minimiZe the potential for weekend SWim meet partiCipants to park on neighbOring residential streets, access and parking Information shall be Included In all SWim meet materials to direct participants to the proper parking location 4 ~. (6) Arrangements shall be made with SMC to permit parkmg of weekend SWim meet team buses In SMC surface parking lots (7) If sWim meets are proposed which will lake place on a weekday while SMC IS m seSSion, a parking management plan shall be prepared pnor to the event to ensure that sufficient off-street parkmg IS available for meet participants SECTION 3 The CEQA mandated environmentally supenor alternative was found to be the proposed project As analyzed In the Final EIR, thiS alternative would result In Impacts that would be equal to or less than the Impacts for the No Project as well as for each of the other alternatIves consIdered SECTION 4 The remaining project alternatives analyzed In the Final EIR, the EXisting Santa MOnica College Site, the One-Way Inbound 16th Street Santa Monica College Site, and the One-Way Outbound Santa Monica College Site would have similar or greater Impacts on the environment as the proposed project. The project alternatives would not aVOId or lessen the Impacts associated with the proposed project SECTION 5 As fully descnbed In Section 2, the Final EIR found that the project would result m significant unavoidable adverse Impacts upon traffic Consistent with Section 15093 of the State of California CEQA GUidelines, the City Council hereby makes a Statement of Overriding Considerations and finds that the benefits of the project outweigh ItS unavoidable environmental Impacts based on the follOWing reasons' (a) The MUniCipal Pool faCIlity Will proVide a valuable recreation faCIlity that serves both 5 i.~~ ~il~ . . the residential commu nlty of local families and citizens as well as the overlapPing day time and residential community of Santa Monica College students. The proposed design Includes both a shallow instruction! recreation pool desIgned for safe use by children, and a large, full size competition pool, providing for the needs of the college students as well as adult SWimmers, and thus providing a recreatIonal facIlity for both families and IndiViduals The public benefit of the MUnicipal Pool FacIlity, which meets the City's goals for Improved and expanded aquatic faCIlities, as well as family recreation, outweighs the traffic Impacts of an Increase of no more than 03% dally tnps to the Immediate neIghborhood (b) While the relocation of the Mu niclpal Pool IS Idenllfled as causing u nmltlgatable traffic Impacts, the Mu nlclpal Pool IS being relocated to the site of a previously eXlstmg 374 space parking structure The relocation of the Municipal Pool thereby creates the publiC benefit of redUCing associated parking structure Impacts to the adjacent neighbors SECTION 6 Consistent With Public Resources Code Section 21081 6, the City Council adopts the MItigation MOnitoring Plan, which IS Included as Attachment A, to mitigate or avoid significant effects of the Project on the environment and to ensure compliance dUring project Implementation SECTION 7 Consistent With Section 21081 6(d) of the California Environmental Quality Act, the documents which constitute the record of proceedings for approving thiS prOject are located In the Planning and Community Development Department, 1685 Main 6 . 1 ., .., .- - i (J . .
