R-8995 e e EPWM:CP:AA:sm s:\sp1446\cc1446ph.196 Council Meetlng: January 9, 1996 Santa Monica, Callfornia RESOLUTION NUMBER 8995 (ees) (CITY COUNCIL SERIES) A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA MONICA FINDING THAT THE PUBLIC CONVENIENCE AND NECESSITY REQUIRES THE CONSTRUCTION OF STREETLIGHTING, REPLACEMENT OF DETERIORATED STREETLIGHTS AND APPURTENANT WORK AND ORDERS WORK TO BEGIN ON VARIOUS CITY STREETS AS SET FORTH IN RESOLUTION OF INTENTION NUMBER 8963 (CCS). WHEREAS, the City Council of the City of Santa Monlca, on the 14th day of November, 1995, passed and adopted its Resolution of Intention, being Resolution No 8963(CCS), declaring its intention to order work described thereln to be done, which Resolutlon of Intention duly and legally was published as requlred by law and notice of said lmprovement has been given ln the manner required by law and all wrltten obJections and protests to the proposed work or the extent of the district to be assessed were heard and considered by the City Council; and WHEREAS, a public hearing has been held duly and regularly pursuant to Resolution No. 8963 (CCS) and the laws and Constitution of the State of California on the proposed construction of streetlighting, replacement of deteriorated streetlighting and appurtenant work thereto, as descrlbed in the Resolutlon No. 8963 (CCS), on: Streetllght Installation: Lincoln Boulevard - from Montana Avenue to Alta Avenue Prospect Avenue - from Marine Street to end of street (dead end) Yale Street - from Montana Avenue to Washlngton Avenue; and e e Streetl~ght Replacement: San Vicente Boulevard - from Ocean Avenue to 4th Street WHEREAS, sald lmprovements have been considered fully, NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SANTA MONICA DOES RESOLVE AS FOLLOWS: SECTION 1 The public interest and convenience requires, and the City Council of the Clty of Santa Monlca hereby orders, the work descrlbed ln Resolution No. 8963 (CCS) to be done on: Lincoln Boulevard - from Montana Avenue to Alta Avenue Prospect Avenue - from Marine Street to end of street (dead end} Yale Street - from Montana Avenue to Washington Avenue San Vlcente Boulevard - from Ocean Avenue to 4th Street Any and all of said protests and objections of every klnd and nature to the proposed work or to the extent of the dlstrict to be assessed be, and the same are hereby, overruled and denied SECTION 2. The City Council hereby resolves that the publlC lnterest and convenlence does not require streetllght lnstallation on: Chelsea Avenue - from Washington Avenue to Idaho Avenue 23rd Street - from Washlngton Avenue to Callfornia Avenue SECTION 3 The City Council hereby finds and determines further that the IISpecial Assessment Investigatlon, Limitatlon, and MaJority Protest Act of 193111 shall not apply to the maklng of said lmprovement. e e SECTION 4. Improvements shall be conducted under the Improvement Act of 1911. whlch is Division 7 of the Streets and Highways Code of the State of Callfornia, and the Street Superintendent and the City Attorney presented to the sald City council the Resolution of Intention requlred by sald Improvement Act to lnitiate the proceedings for sald improvements. SECTION 5. After the bid package has been prepared, the City Clerk hereby is dlrected to post a notice for five days on or near the door of the Clty Council Chambers of the City Hall inviting sealed proposals or bids for doing the work ordered and referring to the speclfications on file and to publish a notlce inviting such proposals for two days ln The Outlook, a newspaper publlshed and circulated in said City. SECTION 6. Reference hereby is made to Resolution No. 8963 (CCS) for a descriptlon of the work, the assessment district, the bonds to be lssued, and for further partlculars. SECTION 7.
