A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA
MONICA ORDERING THE CONSTRUCTION OF CONCRETE GUTTERS,
ALLEY IMPROVEMENTS, STREET RESURFACING, SIDEWALKS,
DRIVEWAYS AND CURB REPAIRS, AND THE REMOVAL OF DAMAGED
PAVEMENT IN PARKWAY AREAS AND APPURTENANT WORK, IN
CONJUNCTION WITH THE FY 1995-96 STREET RESURFACING
PROGRAM AS SET FORTH IN RESOLUTION OF INTENTION NUMBER
8945 (CCS) AND AMEND SECTION 5 OF RESOLUTION OF INTENTION
NUMBER 8945 (CCS), IN THE CITY OF SANTA MONICA
WHEREAS, the Clty Council of the Clty of Santa Monica on the
10th day of October, 1995, passed and adopted its Resolution No
8945 (CCS) setting a publlC hearing and describlng lts intention to
order work described thereln to be donei and
WHEREAS, written notices and postlng of said improvements have
been given in the manner required by lawi and
WHEREAS, any and all written objections and protests to the
proposed work or the extent of the district to be assessed will be
heard and be considered by the Clty Councll,
WHEREAS, sald lmprovements has been consldered fully,
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SANTA MONICA
DOES RESOLVE AS FOLLOWS:

SECTION 1. The public convenience and necessity requlres and
the City Council of the City of Santa Monica hereby orders the
construction of concrete gutters, alley improvements, street
resurfacing and repair of damaged sldewalks, driveways, and curbs
and the removal of damaged pavement ln parkway areas as described
ln Resolutlon No 8945 (CCS) to be done along:
STREETS TO BE RESURFACED, ALLEYS TO BE RECONSTRUCTED, AND GUTTERS
TO BE CONSTRUCTED (Commercial and Industrial Properties Assessed On

SECTION 2.
All protests and objections of every kind and
nature to the proposed work are hereby overruled and denied.
SECTION 3.
Desp1te reference 1n Section 5 of Resolution
Number 8495 to the contrary, bonds will be issued for all
assessments on commercial and industr1al properties descr1bed in
such Resolution of Intention.

amended
to
reflect
such
change.
SECTION 4.
Pursuant to Streets and Highways Code Sectlon
5880, the Street Superlntendent is directed to commence the
construct1on of concrete gutters, alley lmprovements, and street
resurfacing Slxty (60) days after glving notice.
Section 5614
calls for the Street Superintendent to repalr damaged sidewalks,
drlveways and Slxty (60) days after giving notice and where
property owners have not diligently and w1thout interruption
prosecuted the repa1r work to completlon
SECTION 5.
The City Clerk shall certify to the adoptlon of
this Resolutlon, and thereafter the same shall be in full force and
effect.
