February 27, 1996 RESOLUTION NO, 9002 (eeS) (City Council) A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA MONICA ADOPTING AN ACCOUNTING ORDER REGARDING EQUIPMENT AND INSTALLATION CHARGES OF CENTURY SOUTHWEST CABLE TELEVISION, INC WHEREAS, the City of Santa Monica (the "Cityn) became certified to regulate baslc cable serVlce rates and associated charges as of October 7, 1993, and has followed regulations prescribed by the Federal Communications Commission ("FCC") for the regulatlon of the baS1C service tler and associated charges (the "FCC Rulesll); and WHEREAS, the City has not yet completed lts reVlew of the November 6, 1995 rate flling for equipment and installation charges associated with the basic service tler by Century Southwest Cable TeleVlslon, Inc. (the II Company II ) and has not reached a declsion regarding the reasonableness of the Company/s proposed charges for such equipment and lnstallatlon, and WHEREAS, the City lS not ln a pOSl tlon to lssue a rate declSlon at this tlme Slnce the Company has not submitted sufflcient lnformation for the Clty to reach a rate decislon; NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SANTA MONICA DOES RESOLVE AND ORDER AS FOLLOWS: SECTION 1 Pursuant to 47 C.F.R. Section 76.933(c) of the FCC Rulesl the Company is hereby directed, from the date of this e e Order untll the date the Company implements any rate decislon lssued by the Clty, to keep an accurate account of all amounts recelved, and on whose behalf such amounts were paid, for equipment and installatlon charges associated wlth the basic service tier on its annual FCC Form 1205. SECTION 2. The City reserves all rights it has under the FCC Rules, ~ncluding the rlght to establish reasonable charges for equipment and lnstallation, and to order refunds, lf the Clty finds that the Company's charges are unreasonable under the FCC Rules, lncluding any modlfications or amendments to such FCC Rules. SECTION 3. The Clty Manager shall cause to be delivered a copy of this Order to the Company. SECTION 4. The ci ty Clerk shall certify to the adoption of this Resolution, and thenceforth and thereafter the same shall be in full force and effect APPROVED AS TO FORM: ~)k MARSHA J~S MOUTRIE .
