R-9031 e e RESOLUTION NO 9031 (CCS) (CITY COUNCIL SERIES) A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA MONICA REVISING THE CITY'S SEWER RATE STRUCTURE WHEREAS, the C1ty Counell may establlsh, amend, or revise from time to tlme by resol~tlOC the rates and serV1ce charges to be charged for prov1d1ng sewer serV1ce to any customer, pursuant to Section 7 04 540 of the Santa Monica Mun1cipal Code; and WHEREAS, 1t 1S the goal of the C1 ty of SanL.a MO!:.lca 's Sustalnable City Program to encourage efflc1ent use of water by sewer customersi and WHEREAS, the followlng sewer rate structures will provide greater equity between customers, NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SANTA MONICA DOES RESOLVE AS FOLLOWS SECTION 1. Discharge factors are hereby establlshed: USER CLASS Slngle Fam1ly Res1dent1al Duplex Resldent1al Tr1plex Res1dent1al Fourplex ReS1dential Over 4 dwelllng units Indiv1dually metered roultl-fam1ly Commerc1al and Industr1al Government Public Schools and Churches Landscape meter DISCHARGE FACTOR 51%- 80% 85% 90% 95% 95% 89% 89% 89% 0% The Utilit1es Manager shall have the author1ty to set any d1scharge factor not covered by the above 11St and to 'Take adjustments 1n d1scharge factors for 1ndlvidual users where 1t 1S determlned that the actual quantlty of sewage discharge 1S substantially d1fferent from that established by the above llst e e SECTION 4. Sewage strength values for lndiv1dual users or for var10US types of users may elther be est1mated or determ1ned by laboratory analys1s, at the d1rect1on of the Utilities Manager. Where sewage strength values are estimaLed, they shall be cons1stent with character1stic sewage strength values which may be approved from time to t1me by the Cal1fornia State Water Resources Control Board, adJusted as necessary for local co~dlt1ons. No sewage strength values for corrwerc1al, industr~al, governmental, institutlonal or other non-res1dent1al users shall be less than sewage strength values establ1shed for resldent1al users may reVlse sewage strength values from tlme to tlme necessary to reflect current condltlons. In the event any user believes that the sewage strength values established by the C1ty for 1ts sewage d1scharge are exceSSlve, said user shall have the opt1on of hav1ng its sewage sampled and analyzed at its own expense by a laboratory approved by the City. The manner, frequency, and durat10n of sampling and analys1s shall be approved by the City to ensure that resultant sewage strength values are representative of all condit1ons of discharges. DUr1TIg the time per10d when sewage 1S belng analyzed, the user shall pay all sewer serVlce charges based on previously establlshed sewage strength values In ~he event analyses show actual strength values to be less than or greater than the prev10usly establlshed values, the City shall either refund or b1ll the user for the d1fference in charges, as appropr1ate. However, no refund or addit10nal b1lllng shall be made for a per10d 1TI excess of 12 months. The City as deemed e e SECTION 5 The sewer rate structure as established by this Resol ut10n will be effectl ve as of July I, 1996, or as soon thereafter as adm1n1stratively reas1ble SECTION 6. Resolut1on Number 8304(CCS) is hereby repealed as of the effect1ve date of th1S Resolut1on SECTION 7 The City Clerk shall cert1fy to the adoptlon of thlS Resolut1on, and thenceforth and thereafter the same shal~ be in full force and effect.
