A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA MONICA
AY~NDING RESOLUTION OF INTENTION NUMBER 9021(CCS) TO MOVE THE
PUBLIC HEARING ON THE CONSTRUCTION OF STREETLIGHTING ON
VARIOUS CITY STREETS FROM JULY 9, 1996 TO AUGUST 13, 1996
WHEREAS, the Clty Council of the Clty of Santa Mon1ca proposes
to lnltlate proceedlngs under the Improvement Act of 1911 and
Government Code for streetllght installatlon on:
23rd Street
from Arlzona Avenue to Wllshlre
Boulevard
from Ocean Park Boulevard to Pearl
Street
from Wilshlre Boulevard to
Washlngton Avenue
29th Street
Prlnceton Street
WHEREAS, Sectlon 19 of Artlcle XVI of the Callfornia
Constltutlon provldes that certaln speclfied debt I1mitation and
ma]Orlty protest provlslons shall not apply, If after the g1vlng or
such reasonable notlce by publicatlon and posting and the hold1ng
of such publlC hearlng as the City Counell of the Clty of Santa
Monlca shall have prescrlbed, the City Cauncll by no less than
four-flfths vote of all members thereof flnds and determines that
the publlC convenience and necesslty requlre the proposed
lmprovements to be made; and

WHEREAS, Streets and Highways Code Sectlon 2804 provldes that
the "Speclal Assessment, Investigation, Llmitatlon, and MaJorlty
Protest Act of 1931ff shall not apply to any proceedlng otherw1se
sUbJect thereto when said lmprovement proceedlng is by a charter
Clty and sald Clty has complled wlth the prOV1Slons of Sectlon 19
of the Artlcle XVI of the Californla Constltutlon; and
WHEREAS, the Clty of Santa Monica is a charter City of the
State of Callfornla,
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SANTA MONICA
DOES RESOLVE AS FOLLOWS:
SECTION 1. Resolution of Intention Number 9021 (CCS) is hereby
amended to move the publlC hearing on the construction of
streetllghtlng on varlOUS Clty streets from July 9, 1996 to August
13, 1996 to meet necessary property owner notification and
publlcatlon deadllnes.
SECTION 2. Notlce lS hereby glven that on Tuesday, 13th day of
Augus~, 1996 at 6:30 p.m., ln the Clty Councll Chambers located in
Clty Hall, 1685 Maln Street, Santa Monlca, California, there shall
be a publlC hearlng before sald Clty Councll for the purpose of
determlnlng whether the publlC convenlence and necessity requlre
the above-descrlbed lmprovement and for the purpose of allowing any

and all persons havlng any objectlons to the proposed work or
lmprovement should not be carr led out In accordance with sald
Resolutlon of Intentlon. Inquiries concern~ng thlS public hearlng
should be d~rected to the Department of Env~ronmental and Publ~c
Works Management, Englneerlng Dlvls1on, at (310) 458-8721.
SECTION 3. The City Clerk shall glve notice of the hearlng by
post.:ng a copy of thlS Resolutlon ln the manner descrlbed by
Streets and Hlghways Code Sectlon 5065 and by publlcatlon as
herelnafter provlded. Any lnterested person may protest against
the proposed lmprovement ln wrltlng flIed with the Clty Clerk at
any tlme not later than the hour set for the hearlng ~n the manner
provlded by Streets and Hlghways Code Sectlon 5220.
SECTION 4. The Superlntendent of streets shall cause to be
consplcuously posted along the llne of sald contemplated work or
lmprovement and also along all the open streets wlthln the said
dlstrlct, notlce of the passage of thlS Resolution of Intentlon in
the manner and form prescrlbed by law.
The C~ty Clerk is hereby lS dlrected to mall notices, ln the
manner and form prescribed by law, of the adopt~on of thlS
Resolutlon to all persons ownlng commerclal, industrlal, or
resldentlal real property ln the herelnbefore descrlbed assessment
dlstrlct, whose names and addresses appear on the last equallzed

assessment roll for the City taxes or as known to the City Clerk.
SECTION 5. The City Clerk is hereby directed to publish this
Resolution, in accordance with Government Code Sect~on 6063, in The
Outlook, once a week for three successive weeks, with at least f~ve
days intervenlng between the respective publication dates, not
counting the flrst day of publication and terminates at the end of
the twenty-flrst day, including therein the first date. The first
publlcation is to be made not less than forty-five (45) days prior
to the date of the above public hearing.
SECTION 6. The City Clerk shall certify to the adoption of
this Resolutlon, and thereafter the same shall be in full force and
effect
