A RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF SANTA MONICA
APPROVING THE MITIGATED NEGATIVE DECLARATION
ON THE MOSS AVENUE PUMPING STATION PROJECT
WHEREAS, a Notice of AvailabIlIty of an InItIal Study and Proposed Negative
Declaration for the Moss Avenue Pumping StatIon Project located at 1631 Appian Way
(lithe ProJect") was published on September 23, 1997 In complIance wIth the CalifornIa
EnVironmental Quality Act (CEQA) and the City of Santa Monica CEQA GUidelines, and
WHEREAS, on October 28, 1997, the City CounCil, as Lead Agency, reviewed
the Imtlal Study and Proposed Negative Declaration,
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SANTA MONICA
DOES HEREBY RESOLVE AS FOLLOWS
SECTION 1 The City CounCil finds that the InItial Study Identified the follOWing
four envIronmental factors as potentIal Impacts of the Project requIring mitigation to a
level of inSignificance SOil displacement, additional traffiC dunng construction, a
construction schedule which could Impact an adjacent construction proJect, Project New

Hope, and construction related nOise and air quality Impacts
SECTION 2 The CIty CouncIl finds that the followIng condItions of approval
Imposed on the Project will mitigate the potentIally adverse environmental Impacts of
the Project to a pOint where no significant effects will occur
1 Displaced unsuitable sOil will be removed dally and transported to an appropriate
disposal location and sOils to be reused will be treated with dust palliative Water
trucks will be used so as to ensure compliance with SCAQMD Rule 403 Erosion will be
controlled by screening or fencing and spray-on sOIl binders will be applIed to freshly
graded salls
2 Traffic control plans, and staging and haul routes will be Incorporated Into project
plans and will be subject to approval by the Parking and Traffic Engineer
3 The constructIon schedule of the Moss Avenue Pumping Station IS designed to
ensure that the first phase of the pumping station construction IS complete before
Project New Hope begins construction, as Incorporated Into a letter of understanding
between the CIty of Santa MonIca and Project New Hope In addItIon, construction
effects will be mitigated to a level of Insignificance by the use of electncally operated
equipment in-lieu of diesel powered equipment to reduce nOise-related and aIr qualtty-
related Impacts Finally, work will be barncaded and screened from the publiC, and
street cleaning will occur dunng construction hours

SECTION 3 The CIty Council has revIewed and consIdered the Initial Study
and Negative Declaration on the Moss Avenue PumpIng StatIon ProJect, together with
any comments received dUring the public review process, prior to acting on the project
SECTION 4 The City CounCil fmds that, based on the Imtlal Study and any
comments received, there IS no substantIal eVIdence that the ProJect, as modified by
the conditions of approval outlined In Section 2, Will have a slgmflcant effect on the
environment, and hereby approves the Mitigated Negative Declaration
SECTION 5 The City Clerk shall certify to the adoption of thiS ResolutIon, and
thenceforth and thereafter the same shall be In full force and effect
