A RESOLUTION OF INTENTION OF THE CITY COUNCIL OF THE CITY OF
SANTA MONICA TO SET PUBLIC HEARINGS ON NOVEMBER 11,1997,
AND NOVEMBER 25, 1997 FOR THE PURPOSE OF DETERMINING
WHETHER OR NOT THE PUBLIC CONVENIENCE AND NECESSITY
REQUIRE THE CONSTRUCTION OF CONCRETE GUTTERS, ALLEY
IMPROVEMENTS, STREET RESURFACING, SIDEWALKS AND
DRIVEWAYS, CURB REPAIRS, RESTORATION OF PARKWAYS, AND
APPURTENANT WORK, IN CONJUNCTION WITH THE FY 1996-97
STREET RESURFACING PROGRAM
WHEREAS, the City Council of the City of Santa MOnica proposes to Initiate
proceedings under the Right to Vote on Taxes Act (PropOSition 218), the Municipal
Imp rovement Act of 1913, and the Government Code for the construction of concrete
gutters, alley Improvements, street resurfacing, repair of damaged Sidewalks, driveways
and curbs, and the restoration of parkways, and
WHEREAS, Section 19 of Article XVI of the California Constitution prOVides that
certaIn speCified debt limItation and majority protest provIsions shall not apply If, after the
giVing of reasonable notice by pubhcatlon and mailing and the holding of a public hearing
as prescnbed by the City Council of the CIty of Santa Monica, the City Council, by no less
than four-fifths vote of all of Its members, finds and determInes that the public convenience
and necessIty require the proposed Improvements to be made, and

WHEREAS. Streets and Highways Code Section 2804 provides that the "Special
Assessment, Investigation, limitation and MajOrity Protest Act of 193111 shall not apply to
any proceedIng otherwIse subject thereto when the Improvement proceedIng IS by a
charter City and the city has complied with the provIsions of Section 19 of Article XVI of the
California Constitution, and
WHEREAS, the City of Santa MOnica IS a Charter City of the State of California,
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SANTA MONICA
DOES RESOLVE AS FOLLOWS
SECTION 1 The City CouncIl proposes to Initiate proceedings for the constructIon
of concrete gutters, alley Improvements, street resurfacing, repair of damaged Sidewalks,
driveways and curbs, restoration of parkways, and appurtenant work adjacent to
residential. and non-reSidential properties on CIty streets as follows

SECTION 2 The total estimated cost of the proposed Improvements IS two million,
eight hundred ninety-nine thousand, eight hundred fifty-one dollars ($2,899,851) The total

of assessments IS estimated to be three hundred twenty-nme thousand, one hundred
nineteen dollars and seventy-seven cents ($329,119 77)
SECTION 3 The Improvements and repairs shall be conducted pursuant to the
MUnicipal Improvement Act of 1913, which IS contained In DIVISion 12 of the Streets and
Highways Code of the State of California and the Right to Vote on Taxes Act (ProposItion
218)
SECTION 4 The criteria used to determine which streets are to be resurfaced and
the method of repair Include age, surface and subsurface conditions, complaints received,
type of use (I e , commerCIal, Industrial or resIdential), current traffic volume, and projected
change of use or traffic volume The proposed work or Improvements In the opInion of the
City CounCil of the City of Santa MOnica are of more than local or ordinary public benefit,
and the City CounCil hereby proposes that the cost of the assessment shall be as follows

Drawing No 6251 which will be on file In the office of the CIty Engineer by the time of the
public hearing The map shall govern for all details as to the extent of the assessment
dlstnct The assessment dlstnct Includes In general the lots and parcels descnbed In
Section 1 above
SECTION 5 Payments on the principal of unpaid assessments and mterest
shall be made by property owners to the City Treasurer and the same shall be disbursed
by him/her or as proVided In the "MUnlClpallmprovementAct of 1913"
SECTION 6 Parcels owned by non-profit organizations which can
demonstrate that the organization receives a welfare exemption from the Los Angeles
County Assessor shall be exempt from thiS assessment
SECTION 7 Notice IS hereby gIVen that on Tuesday, the 11th day of
November, 1997. and Tuesday, the 25th day of November, 1997, at 630 PM, In the City
Council Chambers located In City Hall, 1685 Main Street, Santa MOnica, California, there
shall be public heanngs before the City Council for the purpose of determining whether
the public convenience and necessity require the above-descnbed Improvements and for

the purpose of allOWing any and all persons having any objections to the proposed work
or Improvements to appear and show cause why the proposed work or Improvements
should not be carned out In accordance With thiS Resolution of Intention InqUIries
concerning the public heanngs should be directed to the Department of EnVironmental and
PubliC Works Management, DIVISion of Engmeenng, at 458-8727
SECTION 8 The City Clerk shall give notice of the hearings by publication
as hereinafter prOVided Any Interested person may file a protest against the proposed
work or Improvements In wntlng With the CIty Clerk at any time not later than the hour set
for the first publIC hearmg In the manner set forth In the Streets and Highways Code
Section 5220 Property owners may also vote on the assessment dlstnct by submitting
ballots before the close of the first publrc hearrng
SECTION 9 City Staff IS directed to mall notices of the adoption of thiS
Resolution and ballots, pursuant to Government Code Section 54954 6, to all persons
owmng property In the assessment dlstnct deSCribed above, whose names and addresses
appear on the last equalized assessment roll for the City taxes or as known to the office
of the City Engineer
SECTION 10 The City Clerk IS directed to publish thiS Resolution, m
accordance With Government Code Section 6066, In The Outlook once a week for two
weeks WIth at least five days intervening between the first date and second date of

publicatIon The first publicatIOn IS to be made not less than 45 days prior to the dates of
the above public hearings
SECTION 11
Pursuant to Public Contract Code Section 20433, the City
Council hereby finds that It IS not In the public Interest to allow property owners to contract
for the street resurfacing, alley improvements, and gutter construction and thereby the City
shall be responsible for awarding and administering the construction contract for thIS
district
SECTION 12 The City Clerk shall certify to the adoption of thiS ResolutIon,
and thereafter the same shall be In full force and effect
