R-9143 e e RESOLUTION NO. 9143 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA MONICA APPROVING THE MITIGATED NEGATIVE DECLARATION AND ADOPTING A MITIGATION MONITORING PLAN FOR THE 1136-1144 FOURTH STREET SENIOR HOUSING /PUBLIC PARKING STRUCTURE PROJECT WHEREAS, a Notice of Availability of an Initial Study and Proposed Mltlgated Negative Declaration, for the senior houslng/public parking structure located at 1136-1144 Fourth Street (Project) was publlshed on November 25, 1996 in compllance with the California Environmental Quality Act {CEQA} and the City of Santa Monica CEQA Guidelines, and WHEREAS, on April 29, 1997, the City council, as Lead Clty Agency, revlewed the Initial Study and Proposed Mitigated Negatlve Declaration, and Mitlgatlon Monltoring Plan, NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SANTA MONICA DOES HEREBY RESOLVE AS FOLLOWS: # SECTION 1. The City Council finds that the Inltlal Study identified potentially slgnlficant effects in the following three areas: l}light and glare, 2}trafflc/clrculatlon/parklngi 3 ) cultural resources. SECTION 2. The City Council finds that the followlng conditions of approval lmposed on the ProJect and agreed to by the Menorah Housing Foundatlon of the Jewlsh Federatlon Councll 1 eff44 e e (Applicant] w~ll avoid these effects or m~tigate the effects to a po~nt where clearly no sign~f~cant effects w~ll occur: 1. Prior to lssuance of a Certificate of Occupancy, the Appl~cant shall des~gn and install exterior bUlldlng light~ng that sheds light pools only on the subject property located at 1136-1144 Fourth Street. North and west facades shall incorporate the minimal light~ng needed to sat~sfy safety requirements. 2. Fln~sh materials, ~ncluding glazing, shall be of a reflectlvlty to minimize glare and shall be reviewed ver~f~ed by the Arch~tectural Review Board. low and 3. Prior to closure of the existing surface parking lot located at 1136-1144 Fourth Street (Lot) and pr~or to issuance of a bu~ld~ng permit, the Appl~cant, w~th approval by the C~ty, shall implement a restriping plan for both Th~rd and Fourth Streets between W~lsh~re Boulevard and California Avenue that will create 42 new metered spaces. Modifications to the east s~de of this block of Third Street will involve restr~p~ng 13 ex~st~ng parallel park~ng spaces for d~agonal parklng. This will y~eld 24 dlagonal spaces, for a net ga~n of 11 new spaces. Modifications to the west s~de of Fourth Street, immediately fronting the subject site, will entail the provis~on of 17 new curb-side parallel park~ng spaces. Mod~f~cat~ons to the east s~de of Fourth 2 eff44 e e Street will entail the provision of 14 new curb-s~de parallel park~ng spaces. Together, the mod~f~cat~ons to the 1100 blocks of Third and Fourth Streets wlll yield 42 new parking spaces ~n the vlClnity of the project s~te located at 1136-1144 Fourth Street. 4. Prior to issuance of a build~ng permit, the Applicant shall subm~t to the Plann~ng and Community Development Department a copy of a recorded lease agreement for 20 park~ng spaces located with~n 1000 feet of the perlmeter of the 1136-1144 Fourth Street parcel for use by drivers who purchase a perm~t to park In elther the Third Street Structure or the Lot(Permit Parkers) during the construction per~od 5. Prlor to implement the the closure of the Lot, the Applicant shall follow~ng notiflcation/education measures to reduce the inconvenience and negative lmpact of the closure of the Lot: A. Notice shall be prov~ded to the buslnesses and employers who use or benef~t from the Fourth Street Park~ng Lot and a copy of the not~ce and a certlflcation of mailing shall be provlded to the City Planning Dlvlsion. B. Notificat~on shall ~dentify the scheduled dates for closure, prov~de maps of alternat~ve park~ng faCll~tles, and urge buslnessesjemployers to not~fy employees and customers of the planned closure and 3 eff44 e e parklng alternatives prior to the scheduled closure dates. C On-slte slgning whlch meets the Slze, height, letterlng and locatlon requlrements of the Zonlng Adminlstrator sign postlng requirements shall be lnstalled notlfYlng customers of the scheduled dates for closure and llsting alternatlve parklng facilities. Durlng the constructlon phase, the Applicant shall place a sign on the Lot, to the satlsfaction of the Clty, identifying available publlc parking locatlons at the Third Street Parking structure and at parklng Structures Number 1 and 2 D. The Applicant shall provlde 100 flyers and one poster each to places of buslness that beneflt from the existing Fourth Street parking lot as identified by City Plannlng staff, notifYlng customers of the scheduled dates for closure, and providing maps of alternative parklng facllities for future VlSltS. 6 Prlor to issuance of a bUllding permit or any demolltlon or gradlng permits, the Appllcant shall inform construction grading crews of the potential for buried archeological and paleontologlcal resources. If resources are discovered durlng the excavations, work in the immediate area of the flnd shall be halted and a qualified archaeologist or paleontologist contacted to determlne the slgnlflcance of the materlals and to develop appropriate follow-up measures. 4 eff44 e e SECTION 3. The City Counc~l has rev~ewed and consldered the Ini t~al Study and M~ tigated Negat~ ve Declaratlon, and the Mitigation Monitoring Plan on the ProJect together w~th any comments rece~ved during the public rev~ew process, prlor to act~ng on the project. SECTION 4. The C~ty Council f~nds that based on the Initial Study and comments received that there is no substantial eVldence that the Project (as modified by the conditions outlined in Sect~on 2} will have a slgnificant effect on the environment, and hereby approves the Mitigated Negatlve Declaration. SECTION 5. The City Councll adopts the Mit~gatlon Monltoring plan, whlch ~s included as Attachment A, to ensure that the required mitigatlon measures will be implemented. SECTION 6. The City Clerk shall certify to the adoption of th~s Resolution, and thenceforth and thereafter the same shall be ln full force and effect. APPROVED AS TO FORM. ~~.
