APPROVIXG THE APPLICATION FOR GRANT FUNDS FROM THE LOS
~~'.[GELES COL~TY DEPARTMENT OF PUBLIC WORKS SANTA MONICA
BAY CD:\1PETITIVE GRANT PROGRAM FOR THE DRY WEATHER RlJ~OFF
RECLA-\1A nON FACILITY
WHEREAS, the people of the County of Los Angeles on November 3, 1992, enacted Los
Angeles County Proposltton A, Safe NeIghborhood Parks, Gang PreventIOn, Tree-Plantmg, Semor
and Youth RecreatIOn. Beaches and WIldhfe ProtectIOn (the PropOSItIOn), whtch, among other uses,
prOVIdes funds to pubhc agenCIes m the County for the restoratIOn and Improvement of the Santa
MOllica Bay by measurably reducmg the tOXICIty of and! or pollutant load m urban runoff to the Bay,
and.
WHEREAS, the City has conducted several feasIbility studtes for the treatment of dry weather
flows from the Pier and Plco\Kenter stonn drams and IS conumtted to a long-term solutIOn, and,
WHEREAS. the PropOSItIOn has authonzed the Los Angeles County Department ofPubhc
Works (the Department) to adrmmster satd funds, and,
WHEREAS, the City wants to apply for these funds to help finance the dry weather treatment
facIhty. and,
'W'HEREAS, the Department has set forth the necessary procedures govemmg apphcatlons
for grant funds under the Propositton, and,

WHEREAS, SectIOns 8 a, 6, and 14 of the ProposltlOn have allocated funds for capItal
outlay projects for the purpose ofrestonng and rmprovmg the Santa Momca Bay, and,
WHEREAS, the dry weather treatment faclhty IS not a mItIgatIon actlVlty reqUIred under
Federal or State laws, and,
\VHEREAS, the dry weather treatment facIltty IS not for the purpose of flood control, and,
WHEREAS, the CIty of Santa MOllica Will pursue all fundmg sources avatlable to provide
any addltlonal funds that may be reqUIred to complete the project If the grant funds reqUIred are
msufficlent and mtends to mamtam the property m perpetUIty,
NOW, THEREFORE, BE IT RESOLVED THAT THE CITY COUNCIL HEREBY
Approves the fihng of an apphcatlOn WIth the Department for funds allocated under SectIon
8 a. 6, and 14 of the Proposltlon for the above named project, and,
2 Certifies that the City of Santa MOllica mtends to pursue all alternatlve sources for addlttonal
fundmg for the dry weather treatment facility If the requested grant funds are msufficlent to
complete the project, and,
3 Recogruzes that the CIty of Santa Maruca mtends to operate and mamtam the property(s) m
perpetuIty If funded, and,
4 Appomts the CIty Manager as agent of the City of Santa Moruca to conduct all negotlattons,
and to execute and submIt all documents mcludmg, but not hmlted to, apphcattons,
agreements, amendments, payment requests, and so forth, which may be necessary for the
completion of the dry weather treatment faclhty CIty Manager may delegate authonty to
execute and subtml to CIty staff, and,

5 Certifies that the CIty of Santa Momca and the Department agree to mdemmfy, defend, and
save harmless the other party agamst any and all hablhttes, expenses, and claIms arlsmg from
or connecled WIth the work, authority, or JUriSdIctIOn, of the respecttve party
