J _'J- A 0 (CITY COUNCIL SERIES) A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA MONICA DECLARING ITS INTENTION TO ORDER THE VACATION OF A PORTION OF THAT CERTA:lli ALLEY KNOWN AS TWENTIETH COURT FROM COLORADO AVENUE TO A POINT 300 FEET NORTH- WESTERLY THEREOF, IN THE CITY OF SANTA MONICA, CALIFORNIA . THE CITY COUNCIL OF THE CITY OF SANTA MONICA DOES RESOLVE AS FOLLOWS: SECTION 1. That the City Council of the City of Santa Monica hereby declares its intention to order the vacation of all of that portion of Twentieth Court from Colorado Avenue to a point approximately 300 feet northwesterly thereof, as shown on the map of Town of Santa Monica, in the City of Santa Monica, County of Los Angeles, State of California, recorded in Book 39, Pages 45-51 of Miscellaneous Records in the office of the Recorder of said County. For further particulars as to the proposed vacation of the hereinbefore mentioned area, reference is made respectively to Map No. 4183, dated May 16, 1974, now on file in the office of the City Clerk in the City Hall, Santa Monica, California. SECTION 2. The City Council of the City of Santa Monica, in vacating said portion of said Twentieth Court, intends to reserve and except from said vacation an easement of full width over the full length of said portion of said Court intended to be vacated, for the purpose of constructing, maintaining, operating, replacing, removing and renewing all sanitary sewers, storm drains, water mains and other pUblic utility facilities and appurtenant structures. SECTION 3. The City Council of the City of Santa Monica, in vacating said portion of' Twentieth Court, intends to stipulate -1- .' " e e e e that in the event the Orchard Tract property on the northeasterly side of the alley is separated from common ownership with the Town of Santa Monica property on the southwesterly side of the alley, the alley herein intended to be vacated shall be rededicated as a public way. SECTION 4. The City Council of the City of Santa Monica further stipulates that the vacating of said portion of Twentieth Court is dependent on the dedication of property and construction of that portion of Broadway Place South from Twentieth Street to Twentieth Court as indicated on said Map No. 4183. SECTION 5. The City Council of the City of Santa Monica, in vacating the above mentioned portion of Twentieth Court from Colorado Avenue to a point approximately 300 feet northwesterly thereof elects to proceed under and in accordance with the pro- visions of the "Street Vacation Act of 1941", being Division 9, Part 3 of the Streets and Highways Code of the State of California. SECTION 6. That the hour of 7:30 01clock p.m. of the C I day of ._/-'-Y , 1974, in the Council Chamber in the City Hall, Santa Monica, California, be and the same hereby is fixed as the time and place when and where all persons interested in or objecting to the proposed vacation may appear before the City Council and offer evidence in relation thereto. SECTION 7. That the Street Superintendent of the City of Santa Monica hereby is directed to cause Notices of Street Vacation to be posted as required by the Street Vacation Act of 1941, being Division 9, Part 3 of the Streets and Highways Code, and the City Council hereby elects to proceed under the provisions of said act. SECTION 8. The City Clerk shall certify to the adoption of this Resolution of Intention and shall cause the same to be published twice in the Evening Outlook, a newspaper published and circulated in the City of Santa Monica, the first of said publica- -2- . .. e e e e tions shall be not less than fifteen (15) days prior to 1974. ~ SECTION 9. That the City Clerk shall certify to the adoption of this resolution and thenceforth and thereafter the same shall be in full force and effect.
