RESOLUTION NO. 45~7 (CCS) (City Council Series) A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA MONICA DECLARING ITS INTENTION TO CHANGE THE RATE OF ~HE ADDITIONAL BUSINESS LICENSE TAX ESTAB- LISHED UNDER ORDINANCE NO. 702, CITY' COUNCIL SERIES, TO ESTABLISH A LIMIT THEREUPON, AND FIXING TIME AND PLACE OF HEARING TO CONSIDER SUCH CHANGE. WHEREAS, this City Council proposes to change the amount of additional business license tax provided for in Ordinance No. 702 (CCS) for the purpose of reducing the total revenue produced by such tax following the addition to and the amending of Sections 62l2, 6212B, 62l2C, 62l2E, 6219, 62l9A, 6225, 6226, 6236, 6240 and 6240A of the Santa Monica Municipal Code relating to the business license taxi and, WHEREAS, since the revenue derived from the additional business license tax established by Ordinance No. 702 will exceed the revenue needs for the purposes set forth therein following the adoption and amendment of the hereinabove recited Municipal Code sections; NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SANTA MONICA DOES HEREBY RESOLVE AS FOLLOWS: SECTION 1. That the City Council hereby declares its intention to amend Ordinance No. 702 (CCS) pursuant to part 5, Division 18, Section 3606l, of the Streets & Highways Code. SECTION 2. That Section 3 of Ordinance No. 702 (CCS) shall be amended to provide for a change in the rate of the additional business license tax provided for therein. SECTION 3. That the City Council intends to amend Section 3 of Ordinance No. 702 (CCS) to read as follows: "Section 3. That beginning with the -1- -- . SIaS 7/IS/74 Rev. 1. . fiscal year 1966-67 businesses in the area as established by this Ordinance and as above described shall be subject to the provisions of the additional tax provided by said law, to wit: That, in addition to the general business license tax imposed on businesses within said city, there is hereby imposed upon businesses located within said area as hereby established, an additional business license tax, and that said additional business license tax shall be five times the general business license tax on businesses within said city and the total business license tax imposed on businesses within said area (including both regular and additional tax) shall be six times the general business license tax imposed on businesses within said city. Provided, however, that in no event, in any case, shall the additional business license tax imposed hereunder exceed the additional business license tax ~mposed for-the fiscal year July l, 1973 to June 30, 1974. Said additional business license tax shall be based upon the same classifications and shall be computed, levied, collected, and enforced in the same manner, at the same times, and with the same penalties and interest, as in the case of the general business license tax. That not~ce is hereby g~ven that the 13th day of August, 1974, at the hour of 7:30 o'clock p.m., 1S the time when and the Council Chambers of thlS Clty Council, ln the City Hall of said Clty, ~s the place where a hearlng will be held by this City Counc11 to consider the rate of and limitatlons on the addltional buslness license tax proposed here~n. Any operator of a business, wlth~n the meaning of Sectlon 36002 of the streets & H~ghways Code of the State of Callfornia, w~thln the proposed area, or any other lnterested person having any Ob]ectlon to the rate of or the lim1tations on the addltlonal business license tax proposed hereln, or to any other action proposed herein, may f~le a wrltten protest wlth the City Clerk of sald Clty, not later than the hour so flxed for hearing. SECTION 5. That the City Clerk shall cause this resolutlon to be pUblished once ln the Evenlng Outlook, a newspaper of general c~rculatlon in sa~d City, and shall cause a completed copy of this resolution to be malled, postage pre- pald, to each retail buslness ln the proposed area, at his business address. The Clty Clerk shall also cause a copy of thlS resolution to be posted at three (3) public places ln the proposed area. Such publicatlon, postlng and ma~ling, shall be completed at least fifteen (15) days prior to the time of the hearlng. SECTION 6. The Clty Clerk shall certlfy to the adoption of thlS resolutlon and thenceforth and thereafter the same shall be In full force and effect.
