A RESOLUTION OF THE CITY COUNCIL OF
THE CITY OF SANTA l'-10NICA ANENDING
SZCTION 1 OF RESOLUTION ~O. 4548,
PERTAINING TO COUNCIL CORRESPONDENCE.
THE CITY COUNCIL OF THE CITY OF SANTA MONICA DOES
RESOLVE AS FOLLOWS:
SECTION 1. Sectlon 4 of Sect~on 1 of Resolutlon No.
4548 lS hereby amended to read as follows:
Sectlon 4.
Council Correspondence.
(a) NON COUNCIL ITEMS. Wr~tten communl-
catlons addressed to the City Council, the subject natter of
whlch comes wlthln the )urisdlction of any board, co~mission,
or department of the Clty, shall be referred to such body or
department, or both, by the City Manager, and such communlcatlons
shall not be placed upon the Councll Agenda.
All communlcatlons directly relatlng to
the work or )urisdlctlon of a board, commlSSlon or department
of the Clty shall be referred thereto, notwlthstandlng the fact
that dlrect Councll actlon may be sought ln such communlcatloni
such communlcatlons shall not be placed upon the Council Agenda.
Any person subm~tt~ng a wrltten communlcatlon
to the C~ty Councll WhlCh lS subsequently referred to a board,
COmffilssion, or department of the City shall be notlf1ed of such
referral by the Clty Manager. If dissatlsflea with elther the
action of the Clty Manager or the actlon of the body or
department to wh~ch the co~unlcation was referred, such person
may appeal to the Clty Councll.
(b) AUTHORITY OF THE C!TY t~NAGER. The
Clty Manager ~s authorlzed to examlne all ~a~l or other written

communications collectlvely addressed to the City Council and
to glve It immedlate attentlon to the end that all adminlstratlvc
bUSlness referred to In sald communicatlons WhlCh does not
necessarlly require councll action may be acted upon between
council meetlngs.
(c) COUNCIL ITEMS. Correspondence
colleetlvely addressed to the Clty Council shall be received
and opened by the City Council secretary, transmitted to the
approprlate publlc offlcer havlng Jurisdlction over lt, and
placed on the agenda if councll actlon is deemed appropriate
by the Mayor, Clty ~anager or City Clerk, except 1n the following
circumstances:
1) No communicatlon which c9ntalns
materlal which: a) 1S profane; b) is 1n the nature of a
cr1m1nal or C1V1I slander, or 1S potentlally slanderous or
libelousj c) advocates or opposes the candidacy of any person
or party for any electlve offlCej d) is primarily an advertise-
ment or promotion or has as a substantlal purpose the advancement
of any cause the major beneflt of which is private and not
publlc, e) does not necessltate councll actloni
shall be placed upon any CLty CouneLl agenda.
d) AVAILABILITY TO THE PUBLIC. Corres-
pondence addressed to ind1vLdual councll members shall not be
opened by the Clty Council secretarr unless authorlzed to do
so by ~nd~v~dual counc~l .members. Such communicatlons shall
not become publlC records untll recelved and flIed by the
Councll at a regular, speclal or adJourned meetlng of the
Counell, or retalned or used as prov1ded 1n S6250 of the
CalLfornia Government Code. Correspondence received 1n the
City Clerk's Offlce or other Clty offlces after 12:00 o'clock

noon two Mondays prior to the Counc~l Meeting shall not be
placed on the agenda unless it concerns a matter to be
cons~dered by the Council at the next regular meet~ng or is
determined by the City Manager to be an urgent matter which
should be brought to the ~mmed~ate attent~on of the Council.
Correspondence shall not be read aloud at a Council meet~ng
unless requested by a maJor~ty vote of the Council. No ~tem
which ~s exempted from disclosure by 56254 of the Californ~a
Government Code shall be disclosed or treated as a publlC
record.
SECTION 2. The C~ty Clerk shall cert~fy to the
adoption of this resolution and thenceforth and thereafter
the same shall be 1n full force and effect.
