RESOLUTION NO .4<;;72 (CCS ~ (CITY COUNCIL SERIES) A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA MONICA DECLARING A FIRE DEP~RTMENT PUMPER TO BE SURPLUS PROPERTY AND AUTHORIZING THE DONATION OF SAID PUMPiill TO THE CITY OF MAZATLAN WHEREAS, the City of Santa Monica and the City of Mazatlan, Mexico are sister cities, and WHEREAS, in connection with that sister city program, the City of Santa Monica and the City of Mazatlan have entered into a program of mutual cooperation, commerce, and friendship; and WHEREAS, the City of Santa Monica now owns a 195~ G.H.C. Van Pelt 1000 GPM pumper which was purchased in 1954; and 'iHEREAS, this pumper has pa,ssed the point of reasonable maintenance costs and parts are difficult and costly to obtain and the City of Santa Monica no longer has use for that equl.pnent; and WHEREAS, the value of that pumper does not exceed the amount of Seven Hundred ($700) Dollars to the City of Santa Monica, but that pumper ."hould be of much greater value to the City of Mazatlan, Mexico; and WHEREAS, it is the desire of the City of Santa Monica to declare that property "surplus property" and dispose of it; and WHEREAS, the donab.on of that property would benefit the mutual exchange, commerce and friendship between the sister cit~eB: NOW THEREFORE, THE CITY COUNCIL OF THE CITY OF SANTA MONICA DOES RESOLVE AS FOLLOWS: SECTION 1. The subject 1954 G.M.C. Van Pelt 1000 GPM pumper is hereby declared to be surplus property. SECTION 2. The C~ty Council finds and determines that the transfer of said property to the City of Mazatlan will benefit the City of Santa Monica in the furtherance of commerce, foreign trade and mutual frienjahip. SECTION 3. All right, title and interest to said 1954 G.M.C. pumper is transferred from the City of Santa Monica to the City of Mazatlan. SECTION 4. BACKGROUND: The sUbJect property, Wh1Ch 15 proposed to be acqulred for the construction of a new anlmal shelter 15 located at 1640 - 9th Street 1n Santa Mon1ca. Technlcally, it compr15es Lots 107, 108 and 109 of the Towner Terrace Tract. This property, upon reVlew of all avallable property for the new anlrnal sight, was determlned by city staff to be the Most sUltab1e and ava21able for the needs of the city. Inltial negotlatlons were undertaken by Clty staff wlth the owner of the property, Fred Nason, WhlCh proved unsuccessful. ?herefore, as a preliminary step to the condemnatlon of the subJect property, the city authorlzed preparat~on of an appralsal report, utl11z1ng the services of LeW1S J. Miller, eRE, ASA. Mr. Ml11er revlewed the property, and made the followlng determinat1ons, among others. The total lot area of the subject property 1S 23,590, plus or minus, square feet, Sllghtly lrregular ln shape. The subject pro~erty does not -1- ~ SIS1ItS 12.2,74 CA e involve any bUlldlng lmprovements and lS baslcally vacant, except for a gated s~x foot high cha~n llnk fence wlth a 0 foot high three strand barbed Wlre security top along the ~ and alley sides of the lot, two wooden fence posts and some gravel ground cover~ Based upon a study of the subJect property, and a study of comparable sales in the area, Mr. Mlller determlned an appraisal value of the subJect property to be in the sum c One Hundred Twenty Four Thousand ($124,000) Dollars. After recelvlng the report of Mr. Miller, the owners of the subJect property were made an offer by the Clty to acqu said property for the sum therein stated. The owners refused thlS offer, but subsequently lndicated a willlngness to sell the subject property to the city for the sum of One Hundred Thll Five Thousand ($135,000) Dollars. ALTERNATIVE SOLUTIONS: The alternative solutions with regard to the subject property are: 1. To authorize the acquisltion of sald propert: for the sum of One Hundred Thirty Flve ?hous~nd ($135,000) Dolle 2~ To proceed with formal condemnation proceedl1 based upon the appra~sal valuatlon of One Hundred Twenty Four Thousand ($124,OOO) Dollars. 3. A thlrd alternative would be to seek other avallable property and dlscontlnue any further attempt to acqulre the subJect property. -2- . - . S I S.S 12. 2 . 74 CA e RECOMMENDATION: It 15 reco~ended that the City Council adopt the attached resolution authorizing the Clty Manager to enter into the attached agreement with Fred Nason and V10lette Nason, owner~ in ]Olnt tenancy, and also thereby authorize the City Controller to issue a warrant 1n the1r behalf 1n the sum of One Hundred Thlrty Five Thousand ($135,000) Dollars for full payment for the subject property. The additional Eleven Thousand ($11,000) Dollars, 1n compar1son to the total purchase pr1ce, does not appear to be sufficient to compel the city elther to d1scontinue efforts toward acquisition of the subject property or to lnstitute condemnat1on proceedings, because such proceed1ngs would be in and of themselves, expensive, and any possible Jury award could certainly exceed One Hundred Twenty Four Thousand ($124,000) Dollars and ffilght exceed One Hundred Thirty Five Thousand ($135,000) Dollars.
