A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF SANTA MONICA APPROVING AND
AUTHORIZING THE CITY ~m~AGER AND ?HE CITY
ATTORNEY TO EXECUTE THE NECESSARY DOCu~mNTS
TO EFFECT A PARTIAL SETTLEMENT OF THE
WATER METER ANTI-TRUST LITIGATION
WHEREAS, the City of Santa Mon~ca has joined w~th
other government entities in the prosecution of ant~-trust
Iltigation agalnst certa~n manufacturers and distributors
of water meters;
WHEREAS, a settlement has been negotlated wlth
regard to a port~on of the cla~m agalnst one of the named
defendants WhlCh settlement has been approved by counsel
for all part~es plaint1ff and w~ll result in a monetary
recovery to the partles pla~ntiff includlng the City of
Santa ~onica~ and
WHEREAS, 1n order to effectuate the partlal settle-
ment and real1ze the funds to which the City 15 entlt1ed,
1t 1S necessary that a Release and Covenant Not to Sue be
executed by the Clty Manager and a Dlsmissal with PreJud1ce
be executed by the City Attorney,
NOW, THEREFORE THE CITY COUNCIL OF THE CITY OF
SANTA MONICA DOES rtESOLVE AS FOLLOWS:
SECTION 1. The Clty Manager is author1zed and
directed to execute the Release and Covenant Not to Sue and
the City Attorney is authorized and directed to execute the
Dismissal With PreJudlce, sald documents belng necessary to
effectuate the settlement.

SECTION 2.
The C~ty Clerk shall certify to the
adoption of th~s resolut~on and thenceforth and thereafter
the same shall be ~n full force and effect.
ADOPTED and APPROVED this 17th day of
December, 1974
