A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
SANTA MONICA AUTHORIZING THE CITY r~NGER TO EXBCUTE
AND DELIVER A RELEASTI AS TO CERTAIN PARTIES DEFENDANT
AND AUTHORIZING THE CITY ATTORNEY TO EXECUTE AND DELIVER
A DISMISSAL WITH PREJUDICE AS TO SAID DEFEND~~TS AND
RATIFYING THE SETTLEMENT OF THE ANTI-TRUST LI'fIGATION
INVOLVING WATER METERS.
WHEREAS, the City of Santa Monlca has jo~ned with other
parties plaint~ff in the prosecution of an antl-trust suit ~n-
volving the sale of water meters; and
WHEREAS, a settlement has been negotiated and ach~eved
with certain named defendants whereby the City of Santa Monica
wl11 receive a sum not less than N~ne Thousand Six Hundred Ninety-
Five Dollars and F1fty-seven ($9,695.57) Cents by way of settlement
as against sa~d defendants; and
WHEREAS, this settlement is ln the best interests of the
City of Santa Mon~ca,
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SANTA
~ONICA DOES RESOLVE AS FOLLOWS:
SECTION 1. The City Counc~l of the City of Santa Monica
hereby authorlzes, approves and ratifles the settlement of the water
meter anti-trust action with regard to defendants therein named
Rockwell Internat~onal corporation, Neptune Internat~onal Inc. and
Badger Meter Incorporated_in exchange for payment to the Clty of
Santa Monica of not less than $9,695.57.
SECTION 2. That the Clty Manager be and is hereby author-
ized and d~rected to execute the release as against the above-named
defendants and that the City Attorney be and lS hereby authorlzed
and directed to execute a dismissal with prejudice with regard to
sa~d defendants.
SECTION 3. The City Clerk shall certify to the adoption

of this resolution, and thenceforth and thereafter the same shall
be ~n full force and effect.
