RESOLUTION NO. 4689 (CCS)

A RESOLUTION OF THE CITY COUNCIL OF
THE CITY OF SANTA MONICA DECLARING
ITS INTENTION TO ORDER THE VACATION
OF A PORTION OF THAT CERTAIN COURT
KNOWN AS LINCOLN COURT FROM THE
SOUTHEASTERLY CITY BOUNDARY TO OZONE
AVENUE IN THE CITY OF SANTA MONICA,
CALIFORNIA.
THE CITY COUNCIL OF THE CITY OF SANTA MONICA DOES RESOLVE AS
FOLLOWS:
SECTION 1. That the C~ty Council of the City of Santa
Monica hereby declares its intent~on to order the vacation of
that port~on of the alley known as Lincoln Court, 20 feet W1de
between the southeasterly City Boundary and Ozone Avenue 1n
Tract No. 9326 as shown on map recorded 1n Map Book 124, Page
50 in the office of the Recorder of Los Angeles County.
For further partlculars as to the proposed vacat10n of
the herelnbefore mentloned Court, reference is made respectlve1y
to Map No. 4225, dated October 20, 1975, now on flle 1n the Off1ce
of the Clty Eng~neer in the City Hall, Santa Monlca, Callfornla.
SECTION 2. The Clty Council of the Clty of Santa Monlca,
~n vacatlng the above mentloned portlon of Llncoln Court, elects
to proceed under and in accordance with the prouisions of the
"Street Vacat10n Act of 1941", being D1V1Slon 9, Part 3 of the
Streets and Hlghways Code of the Sate of Ca11fornia.
SECTION 3. The Clty CounCl1 of the City of Santa
Monlca, In vacatlng sald portlon of sald Lincoln Court, intends
to reserve and except from sa~d vacat~on an easement of full
wldth over the full length of sald portion of sa~d Court intended
to be vacated, for the purpose of constructlng, malnta1ning,
operatlng, replacing, remov1ng and renewing all public utllity
facll1tles and appurtenant structures.
SECTION 4. That the hour of 7:30 o'clock p.m. of the
18th day of November, 1975
, in the Council Chamber in the City
Hall, Santa Monica, Callfornia, be and the same hereby lS flxed
as the time and place when and where all persons lnterested ln
or obJecting to the proposed vacatlon may appear before the Clty
Council and offer eV1dence lD relat10n thereto.

SECTION 5. That the Street Super1ntendent of the C1ty
of Santa Monica hereby is directed to cause Notices of Street
Vacat10n to be posted as required by the Street Vacat10n Act of
1941, be1ng Div~slon 9, Part 3 of the Streets and Highways Code,
and the City Council hereby elects to proceed under the provislons
of said act.
SECTION 6. The C1ty Clerk shall certify to the adopt1on
of th1S Resolut1on of Intentlon and shall cause the same to be
publlshed twice 1n the Evenlng Outlook, a newspaper publlshed
and clrculated in the Clty of Santa Monlca, the first of sald
publlcations shall be not less than fifteen (IS) days prlor to
November 18 , 1975.
SECTION 7. That the City Clerk shall cert1fy to the
adoption of this resolution and thenceforth and thereafter the
same shall be in full force and effect.
