R-4704 ,A ,SIS:Jst 5-19-75 a RESOLUTION NO. 4704 (CCS) (C~ty Counc~l Series) A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA MONICA DECLARING ITS INTENTION TO FUND COSTS OF THE CITY'S WASTE WATER SYSTEM IN ACCORDANCE WITH PUBLIC LAW 92-500. WHEREAS, the City of Los Angeles is requ~red by Federal Water Pollution Control Act (Public Law 92-500) and State Law (Porter-Cologne Water Quallty Control Act, 1972 Amendments) to upgrade its wastewater treatment fac~llties to prov~de full secondary treatment; and, WHEREAS, the C~ty of Los Angeles ~s comm~tted by prev~ous "Clean Water" grant agreements to cease the discharge of wastewater sludge to the oceanj and, WHEREAS, the C~ty of Los Angeles Wastewater System Program projects necessary to accompllsh the preceding goals will cost approximately Three Hundred M~llion ($300,000,000.00) Dollarsj and, WHEREAS, the C~ty of Los Angeles and the City of Santa Mon~ca have a contract provldlng for sewage transportatlon and dlsposal; and, WHEREAS, lt would be beneficial to both the Clty of Los Angeles and the Clty of Santa Monica to participate to receive approximately Two Hundred F~fty Mllllon ($250,000,000.00) Dollars in grant asslstance to accomplish these goals by continuing to participate with the Federal and State governments in the "Clean Water Grant Program"; and, WHEREAS, to be eliglble to particlpate ln the grant program, the City of Los Angeles and the Clty of Santa Monlca must have a revenue program for wastewater treatment works -1- ~ " comply~ng with Federal and State requ~rements: and, WHEREAS, the Comptroller General of the United States has ruled that the use of ad valorem taxes as a user charge system for wastewater treatment works does not satisfy the statutory requ~rements of Public Law 92-500: and, ,VHEREAS, the Clty of Santa Monica's current revenue program includes the sign1f~cant use of ad valorem tax funds to meet the costs of operat~on and ma~ntenance: and, WHEREAS, a reV1S1on of the City of Santa Mon~ca's current revenue program ~s necessary 1n order to qualify for future Federal and State grant ass~stance for our wastewater treatment system. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SANTA MONICA DOES RESOLVE AS FOLLOWS: SECTION 1. That in order to qual~fy for future State and Federal "Clean \1ater" grant assistance, the City Counc~l of the C1ty of Santa Monica states 1tS 1ntent to revise the revenue program for the funding of operat1on and maintenance costs (1ncluding replacement) of the City's wastewater system to meet the requ~rements of Public Law 92-500 and the State Water Resources Control Board. SECTION 2. The City Clerk shall cert1fy to the adopt1on of this resolut1on, and thenceforth and thereafter the same shall be 1n full force and effect.
