A RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF SANTA MONICA
AMENDING SECTION 5 OF RESOLUTION
NUMBER 28l2(CCS} PERTAINING TO
FEES FOR co~mERCIAL S~ILL AND
MOTION PICTURE FIL~ING ON CITY
OWNED PROPERTY.
CITY COUNCIL OF THE CITY OF SANTA MONICA DOES RESOLVE
AS FOLLOWS:
SECTION 1.
That Sectlon 5 of Resolutlon Number 2812
(ces) be and hereby lS amended to read as follows:
Sectlon 5. Plctures for commerclal purposes.
A. The Department of PubllC Works sh~ll lssue

all permlts for the use of any Clty property for any purpose
relatlng to the fllmlng of motlon plctures, maklng of teleVl-
slon fllms, and taklng of stlll plctures for commercial purposes.
Appllcatlons for such permlts shall be made upon forms provided
by the Department of Publ1C Works. Such permits shall spec1fy
the locatlon to be used, the daters) and time(s) for which such
perm1t 1S deslred and shall set forth such speclal condlt1ons
regard1ng the use of such perm1ts as the Dlrector of PubllC
Works shall, ln hlS d1scret1on, determlne. Such permlts shall
also set forth the fee or charge which 15 to be pald to the City
at the tlme the perrnlt 1S issued.
Each permlt shall specify that no reference
shall be made by dlalogue or plcture to the Santa Monlca Pollce
Department, ltS offlcers or personnel, or to the City of Santa
Monlca, except as persons famlliar with the community mlght
recognlze the locale.

B. Fees. The schedule of fees to be charged
for the lssuance of a permlt for the fl1mlng of commerclal
motlon pictures, commerclal teleV1Slon fl1ms, or commerclal
stll1 photography on Clty property, for each day or portlon
thereof are hereby established as follows:
Fees for all stl11 photography

Fees for commerclal motion
plcture and televlslon fl1mlng

C. Fees for use of Clty personnel. For any
locatlon or area the use of which occaSlon speclal dlfflculty
or expense to the Clty, thereby requlrlng the use of Clty
personnel ln any capacity In connectlon with such commerclal
fllmlng or photography, and for the use of City personnel for
general assistance, supervlsion, or other purposes for such
filming or photography, an addltlonal charge shall be made
against and payable by the per~ltee at the rate of Flfteen
Dollars ($15) per hour per employee.
D. Penalty fees. Notwithstandlng any other
proVlslon ln this resolutlon, no fl1mlng of cornmerclal motion
plctures, commerclal televlslon fl1ms, or commerclal stl11
photography on City property shall be lnstltuted by any permlt
holder ln any resldentlal nelghborhood of the City after 10:00
o'clock p.m. In additlon to any other penaltles provlded by
law, ln the event that a permltee or other person vlolates the
proVlsl0ns of thlS subsectlon, an addltional fee shall be charged
as follows:

E. Insurance. Each perm~t shall contain a
statement that the permitee holds the C~ty harmless from any
and all l~abillty for personal ~nJury and property damage
ar~s~ng out of the use of the perm~t and the use of Clty
property and fac~l~t~es. In add~tion, each perm~tee, as a
cond~tion of the issuance of a perm~t, shall first prov~de
publlC llabll~ty ~nsurance nam~ng the C~ty of Santa Mon~ca,
lts agents. servants and employees as co-~nsureds, in amounts
of not less than One Hundred Thousand Dollars (SlOO,OOO)
bodily lnJury ~nsurance for anyone person, Three Hundred
Thousand Dollars ($300,000) bodily ~nJury ~nsurance for any
one accldent, and property damage insurance in an amount not
less than Flfty Thousand Dollars ($50,000) per occurrence.
Such certlficate of lnsurance shall be furn~shed to the Dlr-
ector of Publlc Works and shall further contaln a provislon
that notlce in w~ltlng lS to be provlded to the Dlrector of
PubllC Works w~thin th~rty (30) days pr~or to cancellat~on of
such policy.
F. The D~rector of Public Works, upon appll-
cat~on for a permit, shall rev~ew the same, and may seek the
adv~ce of such other City departments as may be effected by
the requested fllmlng or photography actlvltles pr~or to
~ssurance of such a permlt. If the Dlrector of PubllC Works
finds that the issuance of such a permlt would constitute a
hazard to the welfare of the community or ~ts c~t~zens or,
pose a threat to publlC safety, or endanger lives or property,
he may refuse to lssue the permit appl~ed for.
G. Students and non-prof~t organizat~ons. A
permlt, as prov~ded for herein, must be obtained by students
or non-prof~t organizations pr~or to engaging in the act~vlt~es

described hereln, but no fee shall be reqUlred of the same
therefore. Students shall supply a wrltten certlflcate from
the school of thelr attendance WhlCh shall state that they are
bona flde and currently enrolled students of such school.
Non-proflt organlzatlons shall supply a certlflcate statlng
that they are exempt and classlfled as non-proflt under federal
and state taxlng statutes.
H. The provlslons of thlS resolutlon shall not
apply to the Santa Monlca C1V1C AudltorlUffi, and fees for the use
thereof shall otherwise be set.
SECTION 1.
The Clty Clerk shall certlfy to the
adoptlon of thlS resolutlon, and thenceforth and thereafter the
same shall be in full force and effect.
