RESOLUTION NO. 4785(CCSL (City Councll Serles) A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF S&~TA MONICA DETER- MINING THAT CERTAIN BUILDINGS, FACILITIES, STRUCTURES AND OTHER IMPROVEMENTS ARE OF BENEFIT TO THE DOWNTO~VN REDEVELOPMENT PROJECT AREA. WHEREAS, the Clty Counc~l on January 27, 1976, approved and adopted the offlcial Redevelopment Plan for the Downtown Redevelopment ProJect; and, WHEREAS, the area of the Clty of Santa Monica lncluded In sa~d Redevelopment Plan is descrlbed as follows: "That certaln parcel of land in the City of Santa Mon~ca, County of Los Angeles, State of Callforn~a, descrlbed as follows: That portlon of land bounded by the northeasterly llne of Fourth Street, elghty feet wide; the southeasterly llne of Colorado Avenue (formerly known as Ra~lroad Avenue), eighty feet wide; the southwesterly Ilne of Second Street, elghty feet wlde; and the northwesterly llne of Broadway (formerly known as Utah Avenue) , eighty feet wide; as shown on amended map of Town of Santa Mon~ca Tract, in the Clty of Santa Monlca, County of Los Angeles, State of Callfornla, as per map recorded in Book 39, -1- CA RLK:~:cam 8-10-76 . Page 45 et seq. of Mlscellaneous Records in the Offlce of the County Recorder of sald County, (herein- after referred to as ~ProJect Area"); and, WHEREAS, Section 33445 of the Health and Safety Code of the State of Californla provldes, ~nter alia, as follows: Sectlon 33445. Notwithstanding the provls1ons of Sectlon 33440, an agency may, wlth the consent of the leg1slative body, pay all or part of the value of the land for and the cost of the lnstallation and constructlon of any bU1ldlng, faci11ty, structure, or other improvement WhlCh lS pub11cly owned either Wlth1n or wlthout the proJect area, upon a determlnation by resolutlon of the agency and local leglslatlve body that such bUlldings, facllltles, structures, or other lmprovements are of beneflt to the proJect area regardless of whether such lmprovement 1S wlthln another project area, or ln the case of a proJect area in WhlCh substantially all of the land 1S publicly owned that such 1mprovement 1S of benefit to an adJacent proJect area of the agency. Such determination by the agency and the local leglslative -2- CA RLK~:cam 8-10-76 . body shall be final and conclusive as to the ~ssue of beneflt to the proJect area..."; and, WHEREAS, a dlspositlon and development agreement was entered lnto between the Agency and Santa Monica P13ce Assoc~ates on or about September 10, 1975, by the terms of which the Agency lS authorlzed to pay all or part of the value of land for and the cost of the installation of parklDg fac~l~t~es, parklng structures, and related publ~c improvements to be located within the Project Area; and, WHEREAS, such park~ng facilitles, parking structures and related lmprovements are of benefit to the ProJect Area because they satlsfy the otherwlse unavailable parklng and trafflc needs and reqUlrements for the Project Area ln accordance with said Redevelopment Plan. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SANTA MONICA DOES RESOLVE AS FOLLOWS: SECTION 1. That the Clty Council hereby consents to the payment by the Redevelopment Agency of the Clty of Santa Monlca of all of the value of the land for and the cost of the lnstallation and constructlon of said park~ng facilltles, structures and related publlC lmprovements, and any part thereof. SECTION 2. That sald parklng facl11tles, structures and related publlC lmprovements are of beneflt to the sald Project Area. SECTION 3. Pursuant to Section 33445 of the Health and Safety Code of the State of Californla, this determ~natlon of the Redevelopment Agency of the Clty of Santa Mon~ca shall be final and conclusive as to the lssue of benefit to the Project Area. -~ CA RLKJIIr:cam 8-10-76 .
