RESOLUTION NO. 4800(CCS) (City Council Series) A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA MONICA ADOPTING A CONFLICT OF INTEREST CODE APPLICABLE TO THE MEMBERS OF THE CITY COUNCIL PURSUANT TO THE POLITICAL REFORM ACT OF 1974. THE CITY COUNCIL OF THE CITY OF SANTA MONICA DOES HEREBY RESOLVE AS FOLLOWS: SECTION 1. ADOPTION OF CONFLICT OF INTEREST CODE. In compllance with Section 87300 of the Government Code of Cal~fornla, the C~ty Council hereby adopts this Confllct of Interest Code. SECTION 2. APPLICATION OF CODE. This Conflict of Interest Code shall be appllcable to members of the C~ty Counc~l, whether acting as a City Councl1 member or as a governing board member or comm~ss~oner of any agency of the City. SECTION 3. DISCLOSUP~. Members of the City Council are requ~red under state law, pursuant to Sect~on 87200 of the Government Code of Californ~a,to disclose investments, interest in real property and income. Therefore, no other or additional dlsclosure requirements are imposed by this Confllct of Interest Code. SECTION 4. CIRCilllSTANCES REQUIRING DISQUALIFICATION. Any member of the City Counc~l, whether acting as a City Council meQber or as a governlng board member or commlSS1oner of any agency of the City must disqualify himself or herself from Mak~ng or partic1pating in the making of any dec1sion 1f it is reasonably foreseeable that the decision will have a material financ1al effect, dlst~ngu~shable from its effect on the publ~c generally, -1- . . Notwithstandlng any of the foregoing, no such City Council member or governing board member or commissioner of any agency of the C1ty shall be prevented from making or participating in the making of any decision to the extent that his or her part1cipation is legally required for the declsion to be made. SECTION 5. DEFINITIONS. Except as otherW1se indicated, the deflnit10ns conta1ned in the Political Reform Act of 1974 {Section 8100 et seq. of the California Government Code) and any Regulat10ns adopted pursuant thereto are incorporated hereln by reference lnto thls Conflict of Interest Code. SECTION 6. The City Clerk 1S directed to forward a certif1ed copy of this resolution to the Fair Political Pract1ces CommiSS10n. SECTION 7. The City Clerk shall certify to the adoptlon of this resolution, and the same shall be 1n full force and effect upon ltS approval by the Fair Political Practices Corrunisslon.
