RESOLUTION NO. 4804(CCS)

A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF SANTA MONICA WAIVING FORMAL BID PROCEDURE
AND AUTHORIZING DIRECT NEGOTIATION FOR PUR-
CHASE OF A METAL SHEAR
WHEREAS, the City has need of a metal shear in its
mechanical maintenance facility to expedite repair of refuse
packer bodies and other heavy equipment; and
WHEREAS, a used metal shear in good working order
is adequate for the City's needs; and
WHEREAS, the ability to act promptly and decisively
is an essential element of favorable purchasing of used
machinery; and
WHEREAS, the formal bid process is not considered
appropriate for opportune purchase in the used machinery
market.
THEREFORE, THE CITY COUNCIL OF THE CITY OF SANTA
MONICA DOES RESOLVE AS FOLLOWS:
SECTION 1. That the City of Santa Monica has need
of a metal shear.
SECTION 2. That a used metal shear is appropriate
to the City's needs.
SECTION 3. That formal bid procedure is not appro-
priate for opportune purchases of used machinery.
SECTION 4. That formal bid procedure is waived for
the purchase of a used metal shear and the City Manager is
authorized to negotiate for this purchase on the open market
without calling for formal bids.
SECTION 5. The City Clerk shall certify to the
adoption of this resolution, and thenceforth and thereafter
the same shall be in full force and effect.
