R-4817 .1. ~~ ~ - " RESOLUTION NO. 4817 (CCS) (CITY COUNCIL SERIES) A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA MONICA FINDING THAT THE PUBLIC l\1ECESSITY, HEALTH, SAFETY AND WELFARE REQUIRES, WITHIN A CERTAIN DESIGNATED AREA, THE UNDER- GROUND INSTALLATION OF WIRES AND FACILITIES SUPPLYING ELECTRIC, COMMUNICATION OR SIMILAR OR ASSOCIATED SERVICES ON ARIZONA AVENUE BE'IWEEN SIXTH COURT AND TWENTIETH STREET AND DESIGNATING SUCH CERTAIN AREA AN UNDERGROUND UTILITY DISTRICT AND ORDERING THE REMOVAL OF POLES, OVERHEAD WIRES AND ASSOCIATED OVERHEAD STRUCTURES WITHIN SUCH DISTRICT AND THE UNDERGROUND INSTALLATION OF SUCH WIRES AND FACILITIES. WHEREAS, a public hearing has been duly and regularly held pursuant to Resolution No. 4797 (City Council Series), Ordinance No. 773 (City Council Series) and the laws and constitution of the State of California on the proposed improve- ment of Arizona Avenue between Sixth Court and Twentieth Street by undergrounding of utilities and appurtenant work thereto as described in Resolution No. 4797 (City Council Series); and WHEREAS, said improvement has been considered fully; NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SANTA MONICA DOES RESOLVE AS FOLLOWS: SECTION 1. The City Council hereby finds the public necessity, health, safety and welfare requires the above described improvement in Such designated area. SECTION 2. Arizona Avenue between Sixth Court and Twentieth Street, together with the property abutting on Arizona Avenue, is hereby declared to be an underground utility district as provided by Ordinance No. 773 (City Council Series) and for further particulars reference is made to Resolution No. 4797 (City Council Series). SECTION 3. The City Council hereby orders the removal of all poles, overhead wires and associated overhead structures (except some communication overhead wires crossing Arizona Avenue) -1- .f . . I .... , . from within the designated underground utility district and the underground installation therein of all wires and facilities required for supplying electric, communication, or similar or associated service. SECTION 4. The City Council hereby fixes December 1, 1978, as the date within which such removal and underground installation shall be accomplished; and April 1, 1978 as the date within which the underground installation shall be completed on all prLvate property affected by this underground district. SECTION 5. Upon the effective date of this resolution, the City Clerk is directed to forthwith comply with the provisions of Section 7906 of the Santa Monica Municipal Code. SECTION 6. The City Clerk shall certify to the adoption of this resolution and thenceforth and thereafter the same shall be in full force and effect. ADOPTED and APPROvED this 23rd day of _ November , 1976.
