A RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF SANTA MONICA SETTING
FORTH PRQCEDURES FOR MAKING APPOINT-
MENTS TO PUBLIC BOARDS AND COMMISSIONS

WHEREAS-t_ t.be State Legislature has amended the
Ralph M. Brown-Act to require that persons appointed to an
offlce by the leglslatlve body of a local agency be so
appointed in open session; and
WHEREASt lt is the deslre and intent of the City
Council_of the City of Santa Monica to comply with such
provisionsi
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF
SANTA MONICA DOES RESOLVE AS FOLLOWS:
SECTION 1.
That the procedure for making
appointments to City Boards and COffiffilssions shall' henceforth
be as follows, except as otherwise provided by the Clty Councll:
a. When a vacancy appears on any board or
cO~lssion, the City Clerk shall publlsh at least once ln the
Santa Monlca Evening Outlook a newspaper of general clrculation,
a public notlce of such vacancy. Sald publication shall be
made not less than thirty (30) days prior to the date a vacancy
is to occur ln those cases where the vacancy occurs as a result
of the expiratlon of the term of appolntment, and where
practical, like notice shall be publlshed where a vacancy
otherwlse occurs. Such notice shall request any lnterested
party to submit hlS or her name and quallflcatlons to the
Clty Clerk. Such notice shall also speclfy the pOSltlon for
which a vacancy has occurred, the term of office for which
the posltlon wlll be filled and a reasonable date by WhlCh
interested parties must submit applicatlons for the positlon.

The date for submlssion shall not be less than fifteen (15)
days prior to the vacancy unless the appointment is to flll
an unexpired term. Where the appointment is to flll an un-
expired term, the notlce shall be fifteen (15) days prior
to the contemplated date of appointment where practical.
b. Applicatlons for the position shall be
made in writing to the City Clerk on forms supplled by the
City Clerk. Appllcatlons once submitted shall be and remain
confidential personnel documents pursuant to Sectlon 6254(c)
of the Californla Government Code.
c. The Clty Clerk shall complle such written
applicatlons as are received by the deadllne date and shall
thereafter cause the matter of filling the vacancy to be placed
upon the Clty Council Agenda and in connection therewlth, shall
transmit to the Clty Council coples of all wrltten applicatlons
which have been recelved.
d. Al nominatlons shall be submitted to the
City Clerk no later than twelve o'clock noon the Wednesday
preceding the Clty Council meeting when the appointment is
to be made and shall be listed on the agenda. No Councllmember
shall submit the name of more than one applicant to flll each
vacancy. Prior to submittlng the name of his or her nominee
to fill such vacancy, each Councilmember shall determlne that
the person nominated wlll serve lf appointed. Thereafter,
the City Council shall conslder the applicants for each
respectlve vacancy at a publlC hearing.
e. Following conslderation of the varlOUS
applicants for each vacancy, the Clty Council shall take a
vote in an open meetlng to determlne who shall be appointed
to the respectlve Boards and commissions.
SECTION 2. Resolutlon No. 4739 (City Council
Serles) is hereby repealed ln lts entirety.
SECTION 3. The Clty Clerk shall certify to the
adoptlon of this resolution, and thenceforth and thereafter

the same shall be in full force and effect.
