R-4893 -, ~ - RESOLUTION NO. 1893{CCS) (CITY COUNCIL SERIES) A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA MONICA DESIGNATING A CERTAIN AREA Mi UNDERGROUND UTILITY DISTRICT, ORDERING THE REMOVAL OF POLES, OVERHEAD WIRES, AND ASSOCIATED OVERHEAD STRUCTURES THEREFROM, AND ORDERING THE UNDERGROUND INSTALLATION OF WIRES M~D FACILITIES FOR SUPPLYING ELECTRIC, COMMUNICATION, AND SIMILAR OR ASSOCIATED SERVICE. WHEREAS, the City Council on June 25, 1968, did adopt Ordinance No. 773 (City Council Series), adding Chapter 9 to Article VII of the Santa Monica Municipal Code, which chapter is titled as follows: "CHAPTER 9 - REGULATIONS AND PRODECURES RE OVERHEAD fu\JD UNDERGROUND UTILITY FACILITIES", and WHEP~AS, the City Council, on February 11, 1969 did adopt an approved utility undergrounding program; and WHEREAS, the City Council desires to designate the area bounded by Ocean Avenue - the Ocean - the northwesterly City Limits - and Seaside Terrace an Underground Utility District; and WHEREAS, the City Council of the City of Santa Monica hereby finds that such undergrounding is in the general public interest for the following reasons: 1. Such undergrounding will eliminate an unusually heavy concentration of overhead distribution facilities; 2. Said street is extensively used by the general public and carries a heavy volume of vehicular traffic; and -1- - - 3. Said street passes through an area which would benefit from the aesthetic improvement resulting from such undergrounding. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SANTA MONICA DOES RESOLVE AS FOLLOWS: SECTION 1. That said City Council proposes to initiate proceedings ror the establishment of an Underground Utility District bounded by Ocean Avenue - The Ocean - The northwesterly City Limits - and Seaside Terrace. SECTION 2. That notice hereby is given that on Tuesday, the 9th day of August, 1977, at 7:30 p.m. in the Council Chambers located in the City Hall, 1685 Main Street, Santa Monica, California, there shall be a public hearing before said City Council for the purpose of determining whether the public necessity, health, safety or welfare requires the above described improvement. SECTION 3. That the City Clerk shall give notice of the hearing by posting a copy of this resolution on the Council Chamber door and by notifying all affected property owners as shown on the last equalized assessment roll and utilities con- cerned by mail of the time and place of such hearing at least ten (10) days prior to the date thereof. SECTION 4. That the City Clerk hereby is directed to publish this resolution in the Evening Outlook on two successive dates, the first publication to be made not less than ten (10) days prior to the date of the above public hearing. SECTION 5. The City Clerk shall certify to the adop- tion of this resolution and thenceforth and thereafter the same shall be in full force and effect. -2- - .,r ADOPTED AND APPROVED this 1977 .
