R-4908 e tI, RESOLUTION NO. 4908 (CCS) (CITY COUNCIL SERIES) A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA MONICA FINDING THE PUBLIC NECESSITY, HEALTH, SAFETY AND WELFARE REQUIRES, WITHIN A CERTAIN DESIGNATED AREA, THE mIDERGROUND INSTALLATION OF WIRES AND FACILITIES SUPPLYING ELECTRIC, COMMUNICATION OR SIMILAR OR ASSOCIATED SE~VICES AND DESIGNATING SUCH CERTAIN AREA AN UNDERGROUND UTILITY DISTRICT AND ORDERING THE REMOVAL OF POLES, OVERHEAD WIRES AND ASSOCIATED OVERHEAD STRUCTURES WITHIN SUCH DISTRICT AND THE UNDERGROUND INSTALLATION OF SUCH WIRES AND FACILITIES. WHEREAS, a public hearing has been duly and regularly held pursuant to Resolution No. 4893 (City Council Series), Ordinance No. 773 (City Council Series) and the laws and constitu- tion o~ the State o~ Cali~ornia on the proposed improvement o~ an area bounded by Ocean Avenue, the Ocean, the northwesterly City Limits, and Seaside Terrace by undergrounding of utilities and appurtenant work thereto as described in Resolution No. 4893 (c.C.s.); and WHEREAS, said improvement has been considered ~ully; NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SANTA MONICA DOES RESOLVE AS FOLLOWS: SECTION 1. The City Council hereby finds the public necessity, health, safety and welfare requires the above described improvement in such designated area. SECTION 2. The City Council hereby finds such under- grounding is in the general public interest for the following reasons: A. Such undergrounding will eliminate an unusually heavy concentration of overhead distribution facilities; and B. Said street is extensively used by the general public and carries a heavy volume of vehicular traffic. SECTION 3. The area bounded by Ocean Avenue, the Ocean, the Northwesterly City Limits, and Seaside Terrace -1- . . is hereby declared to be an underground utility district as provided by ordinance No. 773 (C.C.S.) and for ~urther par- ticulars reference is made to Resolution No. 4893 (c.c.s.). SECTION 4. The City Council hereby orders the removal o~ all poles, overhead wires and associated overhead structures ~rom within the designated underground utility district and the underground installation therein o~ all wires and ~acilities required for supplying electric, communication, or similar or associated service. SECTION 5. The City Council hereby fixes twenty-four (24) months ~rom the ef~ective date of this resolution as the time within which such removal and underground installation shall be accomplished. SECTION 6. Upon the effective date o~ this resolution, the City Clerk is directed to forthwith comply with the provisions of Section 7906 of the Santa Monica MUnicipal Code. SECTION 7. The City Clerk shall certify to the adop- tion of this resolution and thenceforth and thereafter the same shall be in full force and effect.
