R-4922 .. - ~ RESOLUTION NO. 4922 (r.CS) (City Council Series) A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA MONICA CONSENTING TO THE SALE OF LAND IN THE OCEAN PARK REDEVELOPMENT PROJECTS I (a) AND 1 (b) BY THE REDEVELOPMENT AGENCY OF THE CITY OF SANTA MONICA TO LINCOLN PROPERTY COMPANY AND THE EXECUTION OF A DISPOSITION AND DEVELOPMENT AGREEMENT RESPECTING SAID LAND WHEREAS, in furtherance of the objectives of the Community Redevelopment Law, the Redevelopment Agency of the City of Santa Monica (hereinafter "Agency") is engaged in carrying out the Ocean Park Redevelopment Projects I (a) and 1 (b) (collectively referred to herein as the "ProJect"); and WHEREAS, there has been prepared and approved by the Agency an Urban Renewal Plan for the Project, consisting of (1) a Redevelopment Plan for Ocean Park Redevelopment Project 1 (a) adopted June 30, 1960 by Ordinance No. 497 of the C.ty Council of the City of Santa Monica (hereinafter "City"), as amended November 14,1967 by Ordinance No. 757 of the City; and (2) a Redevelopment Plan for Ocean Park Redevelopment Project I (b) adopted January 17, 1961 by Ordinance No. 516 of the City. as amended January 26, 1965 by Ordinance No. 667 of the City and September 12, 1972 by Ordinance No. 896 of the CitYi as they may be modified or amended in accordance with the provisions of the CommunIty Redevelopment Law and with the approval of Lincoln Property Company (hereinafter "Redeveloper"), (which plans are hereinafter collectively called the "Redevelopment Plan"); and WHEREAS, the Agency certified an Environmental Impact Report for the PrOject on July 13, 1976 by Resolution No. 334 (R.A.S.) of the Agency; and WHEREAS, the Agency proposes to enter into a Disposition and Development Agreement with the Redeveloper for the sale of certain land within the Project (generally, the area bounded by Neilson Way, Barnard Way, Ocean Park Boulevard and the southerly city boundary of Santa Monica, more fully described in the proposed Agreement), and the development of said land (hereinafter, the "Property") for uses in accordance with the Redevelopment Plan; and WHEREAS, the City has considered the information presented in the Initial Study prepared for the proposed sale and Disposition and Development Agreement in accordance with the Cal ifornia Environmental Quality Act and State and local guidelines adopted pursuant thereto; and 't. . . -2- WHEREAS, the proposed Disposition and Development Agreement contains all the provisions, terms and conditions, and obligations required by State and local law; and WHEREAS, the Redeveloper possesses the qualifications and financial resources necessary to acquire the land and insure development of the Property in accordance with the purposes and objectives of the Redevelopment Plan; and WHEREAS, pursuant to the California Community Redevelopment law (Health and Safety Code, Section 33000 et seq.), the Agency has held a publ ic hearing on the proposed sale of the Property and the proposed Disposition and Development Agreement; and WHEREAS, the City has duly considered all terms and conditions of the proposed sale and bel ieves that the development Agreement is in the best interests of the City and the health, safety, morals, and welfare of its residents, and in accord with the publ ic purposes and provisions of the applicable State and local law and requirements; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCil OF THE CITY OF SANTA MONICA AS FOllOWS. SECTION 1. The City hereby finds and determines that: (a) Neither the approval nor the implementation of the proposed sale and Disposition and Development Agreement will cause substantial changes in the Project or the circumstances under which the Project is undertaken such that new environmental impacts will result which would require major revisions in the Environmental Impact Report previously adopted for the Project due to the involvement of new environmental impacts not covered in said previous Environmental Impact Report; and (b) No Subsequent Envi ronmental Impact Report or Supplement to an Environmental Impact Report is necessary or required; and (c) Neither the approval nor the implementation of the sale and the Disposition and Development Agreement will have a significant effect on the env i ronmen t. SECTION 2. The City consents to the sale of the Property and the execution and implementation of the Disposition and Development Agreement by the Agency.
