A RESOLUTION OF THE CITY COUNCIL OF
THE CITY OF SANTA MOnICA DECLARING
ITS INTENTION TO GRANT A FRANCHISE
TO SOUTHERN CALIFO&~IA GAS COMPANY
AND FIXING THE TIME AND PLACE FOR A
HEARING OF OBJECTIONS TO THE GRANTING
'IHEREOF.
WHEREAS, the City of Santa Mon~ca Granted a franch1se
for the transmission and distr~butlon of natural gas ~n the
C~ty of Santa Mon~ca to Southern Countles Gas Company of
callfornia, a predecessor of Southern Cal~fornla Gas Company
on or about I>~y 3, 1937; and,
WHEREAS, said franch~se has expired; and,
WHEREAS, 1t ~s necessary to prov~de for the transmlss~on
and dlstrlbut~on of natural gas and for the laY1ng of p~pes
therefor with~n the C~ty of Santa Mon1ca; and,
WHEREAS, the C~ty Counc~l of the Clty of Santa Monica
has rece1ved from Southern Cal~forn~a Gas Company, a corporat~on
organized and exist~ng under and by v1rtue of the laws of the
State of Cal1forn~a, and engaged as a publ~c utility corporation
~n transmitt~ng and d~str~buting gas for all purposes to
consumers and var~ous mun~c~pal1ties and communltles ln the
State of Callforn~a, 1ncluding the C1ty of Santa Monica, an
appl~cat1on, under and pursuant to the prov~sions of D~V1S1on 3,
Chapter 2 of the Publ1c Ut1l1t~es Code of the State of
California and the C~ty Charter of the Clty of Santa Mon1ca,
for a franchlse, which said applicat10n states, in compliance

does hereby declare 1ts intent~on to grant a franchise to
lay and use pipes and appurtenances for transm~tting and
distr~but~ng gas for any and all purposes under, along, across
or upon the public streets, ways, alleys, and places in the
C1ty of Santa Monica to the Southern California Gas Company.
SECTION 2. That sa~d franch~se is proposed to be
granted for an ~ndeterminate term, pursuant to Sect~on 6264
of the Publ~c Ut~llt~es Code of the State of Cal1fornia and
Sect~on l602 of the C~ty Charter of the C~ty of Santa Mon~ca.
SECTION 3. That November S, 1977, at 7:30 o'clock
p.m., at the Santa Mon~ca C~ty Council Chambers is the place
and t~me hereby f~xed for a hear~ng on said proposed granted
franch~se whereat any persons having an interest there~n or any
obJection to the grant~ng thereof may appear before the C1ty
Council and be heard thereon (the t~me so fixed for such hear1ng
be~ng not less than twenty (20) nor more than s~xty (60) days
after the date of the passage of this Resolution).
SECTION 4. That the applicat~on for sa~d franch~se
states, and Southern Californ~a Gas Company, ~ts successors
and assigns w~ll, lf the franch~se is granted, during the
l~fe of sa~d franch~se, pay to the City of Santa Monica, two
(2%) percent of the gross annual receipts of Southern Callforn~a
Gas Company ar~slng from the use, operation or possess~on of
sa~d franch~se; prov~ded, however, that such payment shall in
no event be less than one (1%) percent of the gross annual
rece1pts of Southern Cal~fornia Gas Company, its successors
and asslgns, der1ved from the sale of gas w~thin the lim1ts

of the City of Santa Mon~ca under sa~d gas franchise. Further,
said percentage w~ll be pa~d annually fro~ the date of the
granting of sa~d franch1se, and 1n the event that such payment
shall not be made sa~d franchlse w~ll be forfeited.
SECTION 5.
The C~ty Clerk is hereby d1rected to
publ1sh this resolut~on at least once within fifteen (15)
days of the passage hereof in the off~c1al newspaper, to wit:
the Santa Mon~ca Even~ng Outlook, pursuant to Section 1601 of
the Santa Monica C~ty Charter.
SECTION 6.
The City Clerk shall certify to the
adopt~on of this resolut~on, and thenceforth and thereafter
the same shall be in full force and effect.
ADOPTED and APPROVED this 11th day of October
1977.
